Summary: The Fourth Amendment protects individuals from unreasonable searches and
seizures by the government (Peak & Herold. 2023). It ensures that people have a right to
privacy in their persons, homes, papers, and belongings. Law enforcement must generally
obtain a warrant, supported by probable cause and approved by a judge, before conducting a
search or seizing property (D’Onfro & Epps, 2023). The warrant must clearly state what is
being searched for and what is being seized. This amendment serves to limit government
power and safeguard personal privacy, ensuring that searches and arrests are conducted
lawfully and with justification, rather than arbitrarily or without proper legal procedures.
