JURI 520: Constitutional Law
Separation of Powers & Executive Power
God said in his word, “Let every person be subject to the governing authorities. For there
is no authority except from God, and those that exist have been instituted by God. Therefore,
whoever resists the authorities resists what God has appointed, and those who resist will incur
judgement. For rulers are not a terror to good conduct, but to bad. Would you have no fear of the
one who is in authority? Then do what is good, and you will receive his approval, for he is God’s
servant for your good.” This scripture conveys the ultimate authority God is and how he is ruler

America, and its legal tradition due to human nature can be flawed. Due to human error,
improper behavior, tyranny, despotism, absolutism, dictatorship and/or not limited to
totalitarianism, the United States had to implement a system of checks and balances to prevent

image in man means he has the capacity to be a "mini-creator" after the pattern God has

laws to the nature of all laws, as established by God.” The framers of the Constitution knew

when they framed our governing document that these civil powers from sinful human governors,
there needed to be separated to ensure the success of this great republic, which is why they
created the three separate branches of government and checks and balances to ensure each
branch was performing their specified duties and not overstepping the power they were assigned.
This literary analysis will present the role of the executive branch of government and how
it is consistent with a biblical worldview. The executive branch by definition “is one of the three
branches of government that carries out and enforces laws, including the president the chief of
the executive branch, vice president, the Cabinet, 15 executive departments, independent federal
