I think that it is a high and powerful branch but not as power as we think. The US Supreme
Court has that power to do what the Judiciary can't. First, the U.S. Constitution is the
supreme law of the land in the United States. It created a federal system of government in
which power is shared between the federal government and the state governments. That
alone puts the judiciary on the same level of power. They do have the powers to interpret,
apply and defend laws in legal cases. They are called upon to help be a decision maker in a
case, but the US Supreme Courts hold more power after their final decision. Something that
cannot be overturned by the judiciary branch or others. One case that goes down in history
as being one of the most controversial cases was Brown v. Board of Education (1954).
When Plessy v. Ferguson was battling over trying to convince the NAACP that separated
schools was still an equal decision where it was eventually reversed. Convincing the courts
that education in separated schools of whites and people of color was ok and it was not.
Hence going forth, was able have our future shaped to be a NOW equal spell of education to
everyone. The judicial branch to some is considered the most and least powerful form of
government. The judicial branch has the powers to interpret laws. However, it doesn't have
the ability to ensure they are enforced. President Andrew address this limitation of the
judicial branch. State can create laws and mandates however the supreme court has the
power to veto it. There are different levels of the judicial system, and the supreme court is
the highest court of them all. The judicial branch primary role is to interpret the constitution.
A supreme court justice does have the power of position as the term for a Supreme court
justice is a lifetime of service. The supreme court has nine judges to prevent a tie on a
judgement. By being able to serve a life term, a Supreme court justice doesn't have
consequences such as having to run for election. This gives them less stress of consequence
so they can focus on the job a hand. I agree that the judicial are the most powerful, the
reason being. Right now, we are dealing with the debate of mask mandates. The supreme
court threw out this judgment for larger companies. By allowing the mandate this is forcing
people to do something they don't believe in, in my opinion goes against their free will. All
judges no matter their beliefs have to uphold the constitution. I disagree, the U.S. Supreme
Court is the highest court in the United States. The federal judiciary operates separately and
consists of lower federal courts. Marbury v. Madison was a Supreme Court case establishing
federal courts had the power to overturn an act of congress. Gideon v. Wainwright was also
a Supreme Court case where Gideon represented himself. The Supreme Court ruled that
under the Sixth Amendment the U.S. would provide attorneys to criminal defendants who
are unable to afford one. After Gideon was found guilty, he filed a handwritten petition to
overturn his conviction for not having a court-appointed attorney. His petition was denied.
Gideon did not accept that answer, Gideon continued to petition his case until he finally was
granted a court-appointed lawyer. Gideon was later retired and was found not guilty. The
federal judiciary requirements In Article III of the Constitution, “The judicial Power of the
United States, shall be vested in on supreme Court. The Courts only have the power
specified in Article III. Their judges hold office for life, as long as they are not guilty of
judicial misconduct. I do agree that the Federal Judiciary does have the most power out of
the 3 branches of government. I agree because they have the power too over rule decisions
and interpret laws that have been made by the other 2 branches of government. In the case
of United States vs Nixon the Supreme Court decided that the Presidents power was limited
and that Nixon had to turn over the recorded conversations he had. It was left up to the
Supreme Court to decide whether the president does not the right to withhold information
and that it violated the separation of powers. In the case of Loving vs Virginia, the Supreme
Court over ruled the state of Virginia's ruling and struck down the anti-miscegenation statues
due to it violating the fourteenth amendment. The requirements for federal judiciary
according to the constitution is not specific. The Justice is usually recommended by
Congress, nominated but the President, and confirmed by the Senate. They do not have to
run for office and once in their position they can stay till they retire. The video from this
week discussed how Alexander Hamilton said that the Judiciary branch of the government is
the weakest branch because it does not have as he said it the sword and the purse. The
federal Judiciary is powerful but I do not believe it is the most powerful branch of
government. ''In the last two weeks of its term, the supreme court reshaped the balance of
power between the President and Congress. While the court's decision on President Trump's
taxes received most of the attention a less - heralded opinion enhanced the President's
already great power, taking another great step toward enshrining a simplistic vision of
American democracy with the President at its centre. At the root of the decision was bad
history''. Washingtonpost.com/outlook/2020/07/14/supreme-court-just-made-president-more-
powerful/ By: Noah A. Rosenblum. The case, Seila LawLLC V. Consumer Financial
Protection Bureau is the case that I found giving the president more power from the
Supreme court. The executive branch of government is an office with only one person the
President, but the power given to him by the Constitution to interpret it as needed or open to
interpretation for him to use his power as he sees fit makes the executive branch more
powerful than the Judiciary. The President can veto legislation giving him final say in laws,
spending, pardons, foreign policy, power to appoint judges and officers and the President is
the hight of military power as Commander and Chief. While the President can be impeached
and Checks and Balances exist for all 3 branches the President's power is far greater than the
judiciary. I feel that the Supreme Court is the most powerful branch of government. The
Supreme Court of United States is the highest court in federal judiciary pf the United States
of America. It has the ultimate and largely discretionary appellate jurisdiction overall federal
and state court cases that involve a point of federal law and original jurisdiction over a
narrow range of cases. One of the U.S Supreme Court decisions I have had personally touch
my life is the ruling of same sex marriage. One of my high school friends is a lesbian and
found a partner that she wanted to share her life and have children with, she also wanted to
be married in the court of law. If the Supreme Court didn't rule in this favour she wouldn't
have been able to fulfil her dream.
The decision was written by Justice Anthony Kennedy.
"No union is more profound than marriage, for it embodies the highest level of love, fidelity,
devotion, sacrifice and family. In forming a marital union, two people become something
greater than once they were, "Kennedy wrote" as some of the petitioners in these cases
demonstrate marriage embodies a love that may endure even past death”. I agree that the
United States Supreme Court has most of the power in the federal judiciary. First off let’s
look at the seats of the supreme court justices. They are comprised of one chief justice and
eight associate justices, who are all nominated by the president of the United States, and
confirmed by the senate. The supreme court also has jurisdiction over all cases that are
brought into federal court, and not to mention all rulings decided by the supreme court are
final, so there is no higher court or person to appeal to. If we look at the supreme courts
ruling decision in the case of Brown versus The Board of Education, the supreme court ruled
unanimously that racially segregated public schools are unconstitutional and they violate the
fourteenth amendment, and this ruling overturned the Plessy versus Ferguson, which created
the separate but equal doctrine. There is also Marbury versus Madison, in which there was a
dispute over who can ultimately decide what the law is. The supreme court ruled that it is
the duty of the judicial department to say what the law is, which gave the court the ability to
dismiss any law, on the grounds that they are unconstitutional. The Supreme court is the
highest court in our land, so I do agree with you that the Supreme court has the most power
in the federal judiciary. You have given two examples of the supreme court making
decisions both of which they declared the law unconstitutional making the law invalid which
is one of the greatest powers of the Judiciary. the judicial branch is the most powerful of the
three branches. The judical branched primary responsibility is to uphold the constitution.
The Legislative branch makes the laws. The executive branch enforces the laws. The judicial
branch can veto any law that is deemed unconstitutional. The judicial branch can veto both
of the other two branches and veto action signed by the president of the United States. The
objective is to asset the laws, and bill and how the effect the nation long term and it affects
the equalities and freedoms for all and society. The judicial branch is the most powerful of

sometimes one of the last resorts for someone looking for their justice. The Supreme Court
also has the power of judicial review, I also agree that the Supreme Court made a good
decision on allowing same sex marriages. While the President can veto legislation, but it
does not give him the final say. The Senate can pass the same law if they get 2/3 majority
vote between the House of Representatives and Senate. Congress has to approve all loans
agreements. The president nominates the justice but Senate must approve them. I agree
President is powerful but not the most of the 3.I agree the case of the United States v. Nixon
is a great example of how the Supreme Court had the power to override the president and as
a result made him resign before he could be impeached. That is a lot of power and authority
to do but they had it done. This means that a case from any court system (including state
courts and military courts) can have a final appeal at the Court. This is another aspect of
how powerful the US Supreme Court is, too.. I would say they are powerful too in the
government. I do believe with all the mandates and stuff it's making a lot of folks to get
rigged vaccine card and just going crazy out here. Most of the branches do serve power to
the government which can determine what needs to been done in the U.S. The case Brown
vs Brown was such historical case. Having children split into different schools because of
color is disgraceful in my opinion. For children of color and whites to be in the same school
having the same rights in education is a must to be treated equally. The only thing that the
judiciary branch does is put people behind bars and enforce the laws that have to be passed
by the legislative branch. Even though they put those laws in action. They have no say so in
anything other than causing people to go to court for crazy and ridiculous fines. I'm not
talking about murders and offenders, I mean the people who go to jail for petty crimes. At
the end of the day they are just trying to get a check. I also disagree that the federal judiciary
is the most powerful branch of the government. Interpreting the laws and being able to
actually pass a law makes a great difference in power and that is why it is said to believe the
Legislative branch is the most powerful of them three. Declaring war is major and only the
legislative branch can do that which is another reason why they are more powerful. Judiciary
branch is said to be the weakest. There have been some historical cases that have come out
of the Supreme Court. Roe vs. Wade is a great example of this. Other historical cases
include Loving vs. Virginia, and Brown vs. The Board of Education, just to name a couple.
Both cases are historical because without Loving, who knows if interracial relationships
would have ever been accepted in America. Brown vs. The Board of Education was actually
four cases considered under one rubric, which I was wasn't aware of, but this case is
especially historical as it looked into segregation in the public school system. These cases
helped to shape Americas future and there is no telling what America today would look like
had these cases not taken place. Because of our federal judiciary and U.S. Supreme Court,
there have been totally different outcomes when it comes to cases. A good example of this is
GIDEON V. WAINWRIGHT, 1963 when Gideon was charged with felony breaking and
entering and was denied counsel due to Betts v. Brady, 1942 in which it was found that a
regular person could represent themselves as long as there were no physical or mental
limitations. It was because of this ruling of the Supreme Court in 1942 that Gideon was
found guilty due to lack of representation. He'd later file a petition with the Supreme Court
to overturn his conviction stating that his rights were denied. The Supreme Court approved
the petition in a unanimous decision. Gideon was retried, appointed representation and found
not guilty of the crime he'd been sent to jail for. It was with this petition that representation
was viewed as necessity instead of a luxury. Legally having to be told your rights and
having the right to obtain representation is something that people take for granted, very true,
but they more than likely aren't aware of the cases and individuals that brought these
injustices to light. The checks and balances serve as a way to make sure that what is
considered and made into laws are agreed upon by the majority. Once that happens though
the Supreme Court is in charge of making sure that it is abided by and is in standards of the
Constitution. Their decisions made a lot of life changing and world changing things happen.
I believe that who is nominated for this positron needs to be a part of it for life. There are so
many changes that can happen in a lifetime, the people need to be aware of the changes and
mature enough to want to see the fairness of the people of the land. Progress can only be
made when people see a problem and are willing to change it. I believe that the Supreme
Court is one of the groups in the government that has helped to do that.
