There is no way that anyone using normal force to replace a plastic
cap, or even the use of a knife to remove a barcode, should have the
capability of weakening a glass jar, so much so that it shatters. Under
strict liability you as the seller are responsible for any defects in your
product, whether you are aware of them or not. I agree with the
judge's ruling. Manufacturers should take pride in their product, so
much so that they take any and all steps necessary to produce a good
quality product. If the judge were to side with the manufacturer,
could you imagine what that would do for future cases? Imagine if
you have a defective lamp that catches your house on fire. Would
the manufacture be off the hook because it wasn't on fire before it
left the factory?
