This contract has been made between the home owner Amada and the contractor, Jason Contractors. The agreement made on 1st of April, 2016 contains the following terms.

1. Cost: the homeowner shall pay $430, 000.00 to the constructor; as a cost for construction of the house and needed profit. The cost shall not exceed the quoted amount. The cost shall be paid in quarter portions after every two months.

2. Construction: the constructor shall provide for all expenses of construction such as materials and labor incurred.

3. Changes: the agreement may be revised as per the owners wish. The expenses adjustments will be made and arrived to by both parties.

4. Time: the construction will start on date 1st of April, 2016 and end on date 1st of November, 2016 or earlier. Any delays will be fined at a 2% of construction cost per every delayed day.

5. Termination: the homeowner reserves the right to terminate the contract at any time. The contactor shall be paid total construction cost incurred up to the point plus a 15% of total cost as profit and overheads.

Contract of Construction Agreement

This is a binding agreement between _________________(Owner’s name printed) and _____________________ (Contractor’s name printed) for the completion of work on the attached blue prints. The work is to be done in the following manner, Owner and Contractor representative must initial in the spaces provided.

· The contractor is responsible for providing insurance to anyone that steps foot on the construction site. Any injuries acquired on the property during construction are faulted to the contractor. AGREEMENT BETWEEN OWNER AND THE BUILDER FOR THE CONSTRUCTION OF A HOUSE

 SECTION 1

This agreement is made______________________________________ {DATE}, between AMANDA {OWNER} and   Jason Contractors Inc. {THE CONTRACTOR} at ________________________________________________________ {VENUE}. The project shall commence on ________________ {DATE} and end on September 1, 2011.

Whereas Amanda wants a house and its entire supporting infrastructure constructed precisely according the specifications in the drawing as provided by the house designer.

Scope: the contractor agrees to do everything in accordance with the drawing and deliver the prototype of the drawing provided on completion of the work. The contractor must also furnish the labor and any other requirements to complete the construction work.

SECTION 2: Price and payments

The owner agree to pay the contractor full amount of $ 430,000 for the strict performance of the works as required by the owner and in accordance with the design specification by the architect. The amount will be divided into monthly installments throughout the working period. All the payments will be ready within thirty days of invoice. However, the last payment will be paid within forty-five days of completion of the construction and building commissioned accordingly.

SECTION 3: ENTIRE AGREEMENT

This document represent the entire agreement between the owner pf the building and the contractor. The document supersedes any prior arrangement done orally or written or any presentations as to the work.

SECTION 4: TIME

Time is of essence to any form of work agreement. The contractor shall provide the estimated time of completion prior to the commencement of the project. The estimate shall contain the anticipated errors and the factors that might cause the error for proper budgeting of the project. The contractor shall provide the owner with the progress of the works on daily basis to determine if the estimated time if enough or needs adjustments.

SECTION 5: DIFFERING SITE CONDITIONS

The contractors shall have full control of the site and notify the owner of problems that might arise on site prior in writing and vivid explanations. The problems might be:

1. 1.      Hazardous metal on site, the hazard may be due to the quantity, concentration of some chemicals or the storing of the metal.

2. 2.      Subsurface or any other material on site that might pose danger and was not indicated in the contract

3. 3.      Persistent natural conditions that can hinder or delay the work and pose danger to the workers on site

The owner shall properly investigate the presence pf the factors provided in the written complains. If the existence of the factors is confirmed, necessary actions shall be taken to correct the situations and the construction work to proceed. The adjustments will be done in accordance with the provision of the constitution on contracts.

SECTION 6: CHANGES IN WORK

The owner shall subject the work to some changes if there are missing things, the changes will come ass additions on the already existing work, deletions or revision of some parts of work. This the owner shall do by official communication to the contractor before, the particular part of work is started. the contractor may also subject the work to some changes is there are fabrications problem, or the material does not reflect the material provide in the drawing. Every change shall come with additional cost for compensation for the additional work to the contractor.

SECTION 7: SUSPENSION OF WORK

The following conditions shall enable the contractor to suspend the work.

1. 1.      If the owner of the work delayed to pay the dues past the agreed date without prior notice, the contractor shall be allowed to suspend the work until the payments is done in full.

2. 2.      When there is dispute on the payment of the extra work done by the contractor due to the additional changes or omissions on the drawings.

3. 3.      If there is evident that the owner will not be able to pay the remaining amount of work

SECTION 8: INSPECTION OF THE WORK

The owner will be inspecting the progress of the work from time to time, therefore, the contractor is charged with the responsibility of making the site works, materials and all other activities accessible to the owner for inspection and certifications. The owner on a daily basis will also inspect the materials and the equipment delivered on site.

SECTION 9: SITE ACCESS

The owner shall be liable to provide all the necessary rights to the contractor regarding the access of the site prior to schedule beginning of the work. This access shall continue until the completion of the work.

SECTION 10: PERMITS, LICENSES AND REGULATIONS

The owner shall provide the permits and licenses with regard to working on the site. The owner of the building shall provide all the documents that allow the operation to go on the site. The contractor shall assist in obtaining of the licenses where necessary. All the activities and the operation on site shall comply with the laws requirements and hence the contractor shall make sure that all the aspects of the laws are observed in the construction activities.

SECTION 11: TERMINATION

The owner has the rights to terminate the work provided a notice is given to the contractor prior to the termination date. Upon, the action, the contractor shall be paid full amount of the total work already done, other additional expenditures like demobilization, and other cost according the contract law.

The contractor may also terminate the contract will the owner fails in any payment agreed on or nay dispute that makes the work difficulty to continue.

SECTION 12: INSURANCE

The contractor shall have insurance to the workers that contains the following coverages:

a)      Workers compensation and employers liability coverages

b)      Commercial general insurance covering the entire contractor operations

c)      Automobile insurance that will include all the automobiles working on site

The owner shall and it won expenses secure the insurance on the bulk insurance consisting of the following coverage. The builders risk insurance. This will cover most of the damages that might occur on site excluding the ones caused by natural disasters like earthquakes. This will allow the owner and the contractor to be able to recover most things in case of accident on site.

SECTION 13: ARBITRATION

Any controversy that may arise from the contract, but was covered in the contact shall be considered breach of the contract and necessary actions shall be taken according to the law. The law shall take the full force of the situation and judgments will follow the protocols of the law of contact as provided in the constitution.

SECTION 14: SIGN OFF

Upon agreeing on the terms of the contract and both parties certified with the condition, the owner and contracted shall sign off in presence of a witness and the advocates of both parties to make the contract bound to the law.

This agreement (“Contract”) is made this 1st of April, 2011, between Jason Contractors Inc. (“Contractor”) and Amanda (“Homeowner”) for the completion of the construction of a 5 bed roomed house for residential purposes.

 The said parties, for the considerations hereinafter mentioned, hereby agree to the following:

 1. Scope: The contractor agrees to furnish all labor, materials, equipment and all other facilities required to complete construction.

 2. Payment: The homeowner agrees to pay the contractor a sum of $430,000 for completion of construction.

The homeowner agrees to pay the contractor bi-weekly progress payments based on amount of work completed.

Final payment to the Contractor shall be made within forty-five days after completion of Construction and submission of the final invoice to Owner.

3. Time: The contractor is to complete construction on or before the agreed upon date of the 1st of April, 2011.

The contractor is to provide the homeowner with a progress and completion schedule and shall conform to that schedule, including any changes to that schedule agreed to between the Owner and the Contractor or required by circumstances beyond Contractor’s control.

4. Changes in Work: Additions, deletions and revisions to construction may be made by the homeowner and must be agreed upon by both the homeowner and contractor.

Both the homeowner and contractor must agree upon any price changes due to changes made in construction.

5. Suspension of Work: The contractor may suspend construction due to failure of payment on the part of the homeowner.

6. Inspection of work: The contractor is to make the construction site accessible to the homeowner at all reasonable times.

7. Termination: The homeowner reserves the right of termination of the project after a written agreement has been made with the contractor.

After termination, the homeowner is liable to pay the contractor for the percentage of construction completed up to the termination date plus 20% of all of Contractor’s actual and incurred costs for overhead and profit.

8. Insurance: The contractor is to cover all expensive of the following insurance costs.

· Workers’ Compensation and Employers’ Liability Insurance

· Commercial General Liability Insurance covering operations of the contractor.

· Automobile Liability Insurance, covering owned, hired and non-owned automobiles.

· Builder’s Risk Insurance, covering damages to the construction site and equipment not caused by natural disaster.

Upon the signing of the homeowner and contractor, all elements of this agreement are final.

Changes may be made to this agreement at anytime once both the homeowner and contractor have reached a new written agreement.
