The Supreme Court decision in the case McCulloch v. Maryland applied the Supremacy Clause in the U.S. Constitution (Article VI Sec. 2). Discuss the following:
- Contrast the preeminence of federal law in Article VI with the 10th Amendment which grants the powers not specified in the Constitution to the states.
- How does the federal government drive changes in state law?
- Are the states limited by federal action or inaction?
- Issues to consider include marriage, education, highway policy, privacy law, environmental policy, and so forth.
