SPT 610 3-1 Discussion: Good Samaritan Law
My state is Alabama; Good Samaritan Laws are only for professional rescuers and public
education employees, unless the emergency is for cardiac arrest. Then, the law will protect
anyone who tries to help. They could be a bystander or a witness to an accident or incident
outside of their clinic or hospital. This law encourages those with medical training to put their
experience and education to use when they encounter a situation that requires emergency action.
According to the Good Samaritan Law of New Hampshire, it gives security to anybody engaged
in an environment of rapid change in reasonable care. Additionally, it specifies that as when the
individual working in the healthcare gets no direct subsidy from the client being provided for or
on their own for the treatment, as long as the deeds of care are executed in reasonable care and
without intentional or recklessness ignorance, they are exempt from personal penalties.(New
Hampshire Good Samaritan, n.d). Also, if any person acts under good faith and uses an AED,
will not be liable unless the acts or omissions were grossly negligent or willful and wanton (New
Hampshire Good Samaritan, n.d). The Good Samaritan Law in New Hampshire sought to obtain
a variety to assist during an emergency until the appropriate personnel arrive, rather than simply
standing by and doing nothing. This is highly intriguing to me as if there were any more apparent
damage to the individual, the person commenting on the situation might simply claim that they
were operating in reasonable care, even though they had no experience or understanding of the
circumstance.
While there is no mention of acting with good intention in Maine, it does prevent anyone who
performs willfully and without assumption of compensation.. They are not held liable for any
harm they may have caused or for the assassination of someone else they may have exacerbated.
Like New Hampshire, probably soon the person exerting is prepared and informed of how to
interact with the individual seeking help (Maine Good Samaritan, n.d).
Maine lacks instructions on using an AED, although New York and New Hampshire do. This
amazes me considering I assume that most states—if not all use a regulation authorizing the use
of an AED. Likewise, New York supplies a plethora of details (depth) on numerous legal
protections (New York Good Samaritan, n.d).
It's quite fascinating to me that only law enforcement officers, firefighters, and medical
technicians are insured by Massachusetts' Good Samaritan Law. No one who is immediately
committed is insured, that could dissuade anyone from lending a hand in a real crisis. I wish to
learn more information about this,, of course. Especially when considering how regularly
disasters and incidents occur in Boston. Medical team may require additional assistance in order
to arrive at the rescue because of the traffic (Massachusetts Good Samaritan Law, n.d).
