The critical factors of this case are that the testator was of sound
mind and body when he signed the will and that there was no undue
influence when he signed it. While there were medical notes that
Ralph suffered from some lack of reasoning and severe pain later that
day, there are no notes specifying either of these at the time he
signed the will. There is testimony from the nurses and doctors that
Ralph seemed to be of sound mental and physical capacity at the
time of signing the will. With that said the judge determined that
there was also no undue influence since Ralph was aware of what
was going on.
Since Kathy was contesting the validity of the will, she holds the
burden of providing the evidence to determine if Ralph signed the
will under undue influence and/or he was not of sound mind and
body to do so. The evidence brought before to the judge did not
prove that these things happened beyond a reasonable doubt.
