Thomas, Clarence. 2000 “Why Federalism Matters.” Drake Law Review 48, no. 2: 231–238.

This article is presenting the thoughts of Clarence Thomas, Associate Justice Supreme

Court of the United State on federalism and why it’s just as important today as it was when it

was created. Thomas believes that defending the constitution is an act of defending the rights of

the American people. He shares in his speech that the constitution has shown grace to Americans

by presenting a steady political, economic, and social wealth for over twenty years. The

foundation of what the American Constitution stands on is inclusive and resilient. Thomas

credits our founding fathers to creating a political system that will withstand generations. He

shares, “our founders made a significant advance in the science of politics, in advance that

allowed them to create a government strong enough to defend itself and the liberties of its people

yet limited enough that it would itself not become the destroyer of those selfsame liberties.”

Political pillars such as Abraham Lincoln and Martin Luth King Jr. held strong the ‘self-evident”

truths that equality is just as much a right to those on the lowest totem pole as it is to those on the

highest. According to Thomas, “This principle of equality is applicable to all men and women at

all times comma and applies as much to the greatest king as to the lowest laborer. A key

consequence of this fundamental principle of human equality is that all human beings lay equal

claim to the unaligned able rights of life, liberty, and the pursuit of happiness.” Thomas,

however, understands that governing is not perfect. Because governments are control by people

over people, powers will be misused. The powers must always put interested of the people above

all else.

Thomas believes federalism was put in place as the first step to work to mussel the

federal governments powers. Federalism assists with hold the national government accountable

even when the simple separation of governments can’t. Federalism may be problematic for those

that believes that majority rules, however, the majority may not take up for the minorities. A

strength from this article was that Thomas was able to include many thoughts and ideas from not

only the Framers, but also other influential figures throughout our history to support his notion

that federalism does matter.

Rubin, Edward L. 2001. “Puppy Federalism and the Blessings of America.” The Annals of the

American Academy of Political and Social Science 574, no. 1 (March): 37–51.

In this article, the author gathers a case against the notion that true federalism no longer

exist. He has termed the false portrayal of federalism, “Puppy Federalism”. According to Rubin,

puppy federalism, appears to be the Framers definition of federalism, but is not. Federalism was

adopted to refrain from requiring subunits to report to a central government. Federalism allows

parties to have voices and take control over certain aspects of the governmental discussions.

However, Rubin believes that federalism no longer exist, and the United States is moving

towards a more centralized style of governing. Rubin argues that real federalism doesn’t exist

because in the United States and instead it’s a superior and inferior administration with a major

lack of trust. According to Rubin, some acts appear to promote true federalism but in essence,

does not. For example, the 104th Congressional Act, the Personal Responsibility and Work

Opportunity Reconciliation which was thought to be created to help children and families

through federal funding had an underline purpose of prevent families from having children out of

wedlock. Rubin believes the federal government is only looking out for what benefits their

agenda. He states, “The methodology is to compel the states to achieve specific results in

according with the state's purpose, rather than compelling them to follow specific procedures.”

According to Rubin, this is not real federalism, it’s puppy federalism. While puppy federalism

concludes that federalism is no longer a thing, Rubin encourages his readers to be encouraged

and to turn its focus on decentralization. “Instead of a theory of federalism we need a theory

about what policies should be centralized what policies should be decentralized, and both cases,

the optimal way for a nation a national government to survive the regional subordinate that we

continue to describe as states.” Decentralization essentially is the central government allowing

state or local governments to run their areas with little power. The goal of the central government

is the driving factor for all actions made. Rubin believes that it’s important to dive into the

methods of federalism and decentralization because it will assist governmental organization with

determining what degree of authority polities will maintain.
