I believe the detainment of Katherine was unconstitutional because
her liberty had been taken away when the arresting officer did not
look over the person he was supposed to be taking into custody. I
think officers should be more aware of the fact that there are twins,
stolen identity, and even cases where there are people with the
same name. I do understand that the officer did compare the
identifying information, but the wanted woman, Katherine’s sister,
should have come up immediately not several days from when the
arrest took place. Soon as Katherine had told the officer of the
mistaken identity, he should have looked more into it to make sure
he had the correct person. Which I do believe is part of due
process, I think the officer should not have stopped at only
comparing the identifying information but go as far as to compare
photo and fingerprints, which hers should have been in the system
already if he, in fact, had the correct person in custody.
Understanding the constitution as defined by the founding fathers,
criminal justice officials can avoid mistakes such as the one that
had been made here with Katherine. The constitution along with
the bill of rights, allow the officials to know the rights of the
citizens as well as the guidelines for the criminal justice process.
The bill of rights is what restricts the government rather than
private groups and individuals (Hendrix, 2013). This means that
criminal justice officials do have restrictions and that they must
act

a certain way when they are engaging with citizens. Fischer had
stated in biblical principals of government and criminal justice,
that we must rule by consent and make use of the constitution as
directed by the book Deuteronomy.
