Stare Decisis: The Cornerstone of Legal Precedent
Stare decisis, Latin for "to stand by things decided," is the fundamental principle of the
common-law system whereby the courts are bound by prior decisions made on similar cases
(Carola, 2020). This doctrine forms the foundation of continuity, reasonableness and certainty in
the legal system, where cases are treated alike in the future. Another significant implication of
the principle of stare decisis is that it helps to maintain legal clarity and stability. It fosters
predictability by giving direction to litigants, legal practitioners, and the public on how such
cases would be determined. This predictability increases confidence in the judicial system and
respect for the rule of law.
Moreover, stare decisis increases judicial efficiency in decision-making since it reduces
the time needed to make decisions. Instead of re-establishing facts that have already been
determined in other trials, judges can use such precedents to solve similar cases quickly. This
saves time for the judiciary and frees up the court system to ensure timely justice delivery.
However, stare decisis is not without its limitations and criticisms. While a firm adherence to
principles strengthens the law's predictability, it can perpetuate legal wrongs or archaic legal
concepts. In situations where legal systems' precedents infringe on current norms or
constitutional provisions, the judiciary feels compelled to set aside prior decisions to achieve
justice and fairness.
Furthermore, the use of stare decisis may differ based on the structure of the courts in the
legal framework. Given the evolving nature of legal interpretation, appellate or supreme courts
are capable of reversing or altering prior cases set by lower courts. In conclusion, stare decisis
remains a cornerstone of the legal system because it helps to strike a balance between rigidity

and change. As a guideline that necessitates order and rationality in judicial decision-making,
this common law fosters a continuous exposition of the application of precedent in the social
transformation of the law.

Your assessment of the legal ramifications of cybersecurity breaches aptly highlights the
severe consequences businesses face, including hefty fines, lawsuits, and reputational damage.
Following regulatory requirements such as GDPR and CCPA is crucial, indicating an increasing
trend towards protecting personal data worldwide (Okebie, 2021). Firstly, the constantly
changing nature of threats in the information environment requires active protection.
Implementing sound legal defences helps minimize legal losses and increase organizational
immunity against cyber threats. In addition, maintaining cybersecurity awareness and raising
employees' awareness of cybersecurity and best practices can help avoid breaches and
compliance with the requirements.
Secondly, the interconnected nature of business ecosystems underscores the ripple effects
of cyber incidents. Breaches disrupt operations and impact partners, suppliers, and customers,
amplifying the need for collaborative cybersecurity efforts across the supply chain. In addition,
one of the most critical trends is the increasing relevance of digital trust. It is crucial for firms to
establish and maintain trust with customers through regular disclosure of cybersecurity
arrangements and proactive management of breaches to avoid negative ramifications on
reputation. Building on the concept of proactive cybersecurity measures, it is crucial to stress that
cyber threats constantly evolve. Organizations have to change their approach to protection
regularly to counter different strategies hackers use. It requires acquiring new forms of

protection, such as AI-based threat identification and prevention tools and amendments of
security measures to reflect new threats. Bravo! I enjoyed reading your work.

Your work on unconscionability was insightful. Unconscionability in contract law serves
as a crucial safeguard against unfair agreements. While the initial definition might suggest
extreme circumstances akin to being under the influence, the courts employ a more nuanced
approach, considering various factors such as the parties' relative bargaining power, deceptive
practices, and contractual terms. Your insight into how unconscionability primarily protects the
"commercially illiterate" sheds light on its purpose within the legal framework (Haber, 2023). It
contributes to fairness by offering redress to those in vulnerable positions during contract
formation, thus promoting justice. Furthermore, your finding that it applies to United States laws
like protective provisions under the Bill of Rights underlines its importance towards ensuring
that the law is equitable. Building upon your observations, I would like to add that the doctrine
of unconscionability not only shields the economically vulnerable from unfair contracts but also
guards against abuse of power by the parties with more vital bargaining positions. This aspect
ensures balance and fair dealings, mainly where contracts govern relations between parties.
Bravo! I enjoyed reading your work.
