Kidnapping and False Imprisonment
In the scenario where an armed bank robber instructs customers within the premises to
remain on the floor and threatens to shoot them if they stand up or try to escape, the act
constitutes false imprisonment rather than kidnapping (Wallin, 2023). Therefore, False
imprisonment is confining a person against their will within a particular area, for example, when
one restricts their employees' movements to the bank floor. As for the customers, they are not
moved from one place to another; therefore, it cannot be referred to as kidnapping as per the
standard definition wherein a person is moved against his or her will.
It is crucial to discern the differences between abduction, false imprisonment, and
kidnapping to address these offences' specifics (Wallin, 2023). Though all make or involve the
unlawful deprivation of freedom of an individual, they differ in their extent or degree. The
distinction between Kidnapping and false imprisonment is that the latter focuses on the
individual being unable to move around within a specific area. In contrast, kidnapping entails
moving a person against their will. Kidnapping may also entail force or enticement to take
someone away, which can be for unlawful purposes such as smuggling them into becoming a sex
slave.
Preserving separate categories of legal classification for such offences enables proper
charging and appropriate penalties depending on the crime's circumstances (Wallin, 2023).
Forced movement, which is inherent in some offences such as kidnapping, for instance, leads to
a more severe consequence because of the risk involved to the physical well-being of the victim.
Therefore, this differentiation helps ensure justice meets the consequences of the offence
committed based on the severity. The law needs to draw meaningful and well-understood

differences between abduction, false imprisonment and kidnapping so that a just system is
provided where only unlawful confinement can be punished.
