Using the newspaper, Internet or other resources, find a news article written within the last six (6) months that illustrates negligence. Include the news article as a separate page in the assignment. The news article can be scanned for easier submission.
Write a 5-6 page paper in which you:
- Summarize the relevant facts and include an identification of the party that would be a plaintiff and the defendant in a lawsuit.
- Identify the four (4) elements of negligence.
- Choose one (1) negligence defense that the defendant could raise to defeat the negligence action. Explain your reasoning.
- Determine whether the plaintiff should proceed with a lawsuit. Explain your reasoning.
- Use at least two (2) quality references. Note: Wikipedia and other Websites do not quality as academic resources.
Your assignment must follow these formatting requirements:
- Be typed, double spaced, using Times New Roman font (size 12), with one-inch margins on all sides; references must follow APA or school-specific format. Check with your professor for any additional instructions.
- Include a cover page containing the title of the assignment, the student’s name, the professor’s name, the course title, and the date. The cover page and the reference page are not included in the required page length.
The specific course learning outcomes associated with this assignment are:
- Distinguish the major elements that comprise the substantive areas of torts and contract law.
- Use technology and information resources to research issues in paralegal studies.
- Write clearly and concisely about paralegal studies using proper writing mechanics.
