Our practice is transnational as we work with international business disputes, dealing with various countries, their cultures, laws, and norms. PART TWO 3. We respect all of the laws and regulations regarding professional responsibility in California, regardless of where we practice. 4. The typical issues involved are primarily those involving contractual disputes and fraud. Companies promise one thing and deliver another. Assumptions are made by both parties based on their backgrounds and maybe cultures and then a clash occurs. 5. Issues: as stated above, the issues are, at the end of the day, breach of contract issues. However, sometimes, there are people and companies who set up situations, knowing that the costs and inconvenience of legal action outweigh the costs of the transaction, and use that as a way to take advantage of someone in another country. PART THREE 1. We engage a lawyer in a foreign jurisdiction when we have to know the laws and regulations that affect our client abroad. We almost always do this if we cannot negotiate a situation rapidly. 2. In terms of finding the best one, we contact lawyers around the world and ask them who the best lawyer is in a specific area; we also contact the local bar association as well as conducting Internet searches. 3. Considerations: Someone who is one of the three best lawyers in their field and has practiced for at least 15 years. An example of a case: A company sold our client some products of low quality. Additionally, my client had to pay customs fees in addition to shipping fees for these defective products, a whole container full of them. They knew that after paying shipping, and they insisted on being paid in advance, that my client would not pursue them because they had a no-refund policy, and on top of that, having paid customs and duty fees and charges, they felt my client would not pursue them. My client was able to have the materials held in a free zone wherein the materials were not considered imported, duty did not have to be paid, the goods were checked and we were able to negotiate a return. These situations happen weekly.
