1. The National Labor Relations Board (NLRB) was created by the U.S. congress in 1935 to administer the National Labor Relations Act (also called the Wagner Act). The primary functions of the NLRB to prevent and remedy unfair labor practices. The second primary function is to establish whether or not certain groups need representation for collective bargaining purposes. The guide contains rules prohibiting recording in the workplace, the first rules encourages employees to be open and honest without feeling they are being video or recorded during meetings. The second rule states that it is in violation of the company policy to recorder conversations with a tape recorder either on a cell phone or electronic device.
Occupational Safety and Health Administration, Congress created the OSHA to assure safe and healthful working conditions for working men and women by setting and enforcing standards and by providing training, outreach, education and assistance. OSHA is a part of the United States Department of Labor. OSHA sets standards for companies to provide a safe working environment for their employees; their standards might require that employers adopt certain policies, methods and processes to protect workers. For example, chefs and cooks working within a kitchen for safety will need slip resistance pads position around the kitchen in high traffic areas so no one can hurt themselves by falling on a wet surface. I believe that as times change OSHA changes safety regulations to keep in line with today’s changing times. For example in their news section OSHA announced the 2016 Step-Up for safety in the Oil and gas industry to raise awareness about hazardous conditions among employers and workers. This program is collaboration between OSHA, the National Service Transmission, Exploration & production. This gives companies the time to conduct inspections at the site location and provide safety training. This program is designed to help minimize the amount of hazardous working conditions.
2. 1st E-Activity: The NLRB "National Labor Relations Board" is the agency that administers the NLRA "National Labor Relations Act" which is concerned with self organization and collective bargaining for workers. They exist to ensure that employees that want to be represented by a union are and that they are receiving the treatment and benefits that they deserve. The NLRB is important because they can notify employees about specific rights that they never knew they had and can ensure that they are executed. In June 2004, a case was filed by the United Auto Workers International Union claiming that the manufacturing firm Newcor Bay City violated the NLRA by implemented a bargaining offer without the employee representatives being present. They were charged of unfair law practices and due to the issues some employees were either laid off, retired or continued working under unfair practices. There was a lot of back and forth in reference to the case and a final decision and order was not executed until April 2011. This awarded current and former employees of almost $700,000 in back pay etc. I am glad that these employees got what they deserved but its a shame that it took so long. Because of this lengthy period of time, obviously some of them were no longer around to receive their payments so it was passed on to there family member. Just the simple fact that the company made a bargaining decision without the union representatives being there makes you wonder if they were trying to cover something up in the first place.
2nd E-Activity: OSHA "Occupational Safety & Health Administration" provides educational programs to ensure that workers are knowledgeable when it comes to the recognition, avoidance, prevention and safety of health hazards that may happen in the work place. Under this law an employer must provide a safe work environment for their employees at all times. This is very important in any work environment it covers both the employer and employee legally if something happens and both followed the rules. This can be very helpful if an employer is trying to "cut corners" and ask an employee to do something that is unsafe and the employee agrees because they were unaware of the safety rules and their rights.
