Introduction
Jade is a college student who is in her last semester with just 5 weeks to go. She has been offered two jobs one in Michigan and the other one in Colorado. In both cases she receives an email from her employers summarizing terms and conditions of the offer. She did not receive the offer on paper from any of the company but rather via e-mail in a pdf file. Both companies required she complete her undergraduate degree by the end of the semester.
Jade decided to accept the Colorado job and she writes back via email that she accepts the Colorado offer and she rejects the Michigan job the same way. This paper generally requires describing the essential elements of the offer that are in this scenario and to justify if there is a contract formed between Jade and the potential employer of Colorado Company.
Essential elements of a contract
Offer
For any contract to be valid there must be a definite clearly stated offer to do something. In this case there was an offer which was made to Jade by the employers of the two company and the offer was to give Jade a job.
Acceptance
It is only what is offered can be accepted, the offer must be accepted without conditions, the acceptance of the offer brings negotiation at the end by establishing the terms and conditions. Acceptance can be given verbally, in writing or inferred through actions. In this scenario Jane accepted the Colorado offer by writing back to them via email.
Intention of the legal consequences
A contract requires that the parties intend to into a legally binding agreement and they must create a legal relationship which should be enforceable by law. Jade and the Colorado employer they intended to create a legal contract that is employment contract which is enforceable y law.
Consideration
For any contract to be binding it must be supported by valuable consideration that is one party promise to do something in return for a promise. Jade accepted the terms and condition of the job under consideration she will get paid at the end of the. The contract between Jade and the employer of Colorado it has money consideration
After Jade sent her email via her smartphone, but before she actually printed out and signed the contract, do you feel that a contract has been formed? If so, why do you believe this to be the case?
Definitely the contract was formed when Jade received an offer from Colorado employer and sent an email accepting the offer. The acceptance of the offer was communicated in a prescribed manner and before the lapse of time it was also communicated to the right person and this makes the contract to be valid.
