1. Gary is a budding entrepreneur who wants to register his car rental business, but does not know what legal entity he should register as. His sister, Renee and Petal, his girlfriend have also shown an interest in joining him in the business venture. (10 marks)
2. While they’re working on the registration, the business is flourishing and Gary has now saved enough money to marry Petal, so he proposes and she says yes. Three months later, after months of arguments, they decide to break up, but Petal loves the ring so much that she refuses to return it to Gary. (5 marks)
3. Gary is expanding, so he hires Charleen and says to her, “We’ll arrange salary when you start”. However, unknown to Charleen, he instead decides to hire Renique. Charleen is excited about finally getting a job after searching for so long, so she takes the long way home to think about starting her first job. She sees a stray dog and being an animal-lover, she picks it up and sees a tag with Renesha’s address, so she returns the dog. On her way home now, Charleen sees a poster on a wall saying, “Lost dog, $500 reward for safe return” with a picture of the same dog she just returned to Renesha. She immediately turns around and heads back to the Renesha’s house to claim her reward, but Renesha refuses. (10 marks)
4. Livia, Kadasha and Odessa were walking home when they overheard the commotion between Charleen and Renesha, the dog owner, and that reminds Odessa that she has to go to Hi Lo to buy dog chow. When they get there, they realise that the chow is priced at $10, instead of $100, so they grab two bags and carry them to check out. The teller informs them that the item is incorrectly priced, but the girls refuse to accept that excuse with Odessa saying, “You have to sell it for that price! It’s your mistake, not mine. I know my rights! I will call my Lawyer Uncle to sue you.” She calls her “Lawyer Uncle”, Tevin who proceeds to advise her. (10 marks)
5. When Livia got home, she started reading the papers and saw a car for sale, so she called the number, as she had been looking to buy a car. Petal, the car owner, answered the phone and said to her, “I’m selling it for $50,000 or nearest offer.” Livia said, “I will pay the $50,000”, but Petal did not pay her telephone bill, and coincidentally got cut off right as Livia was about to start speaking. Petal ended up selling the car to Shanice G., and when Livia came the next day, she was upset and threatened to sue her. (10 marks)
6. Petal, now ready to buy a newer car, decides to purchase one from her neighbour, Shanice G. After paying and a receipt being issued, they arranged to meet at Licensing Office to transfer the vehicle the following day. When they met, Petal remembering that she had not enquired about the engine’s condition asks Shanice G. about it, who tells her that the engine is in excellent condition. In an effort to allay her concerns, Shanice G. says, “I’ll write it on the receipt to prove that I am telling you the truth”. Petal liked the idea, so Shanice G. proceeded to write *This is to certify that the engine on PDA 1349 is in excellent condition*. Petal took the receipt and jumped into the car to rush to her Business Law class with her favourite lecturer. As she turned onto Melville Lane, the car stalled. (5 marks)
7. Sabrina went to buy a lot of land from Suzette, who said: “I am selling it for $100,000.” Later that day, after Sabrina discussed it with Marisa, her business partner, she sends Suzette a text saying, “I’ll take the land if it includes the Lawyer fees. If you don’t reply, I’ll take that as a yes and we have a deal.” Sabrina and Marisa sell their respective cars to pool the money together to buy the land, but Suzette refuses to sell them. Suzette decides to sell the land instead to Tanasha who says, “Wouldn’t you accept $90,000?”, to which Suzette replies, “No”. Tanasha then says, “Ok, I’ll take it”, but Suzette ignores her and walks away. Tanasha decides to take Suzette to court because she refused to sell her the land. (10 marks)
8. Stacy-Ann goes to the hospital very sick, where Dr. Melissa has given up on her and tells her family members, that she won’t make it Stacy-Ann’s wealthy uncle, who happens to be car rental owner, Gary, offers to give Dr. Melissa $50,000 if she saves her life. Dr. Melissa now goes above and beyond, and succeeds in saving Stacy-Ann, but Gary refuses to pay. Stacy-Ann, thankful for her uncle’s intervention promises to give him $1000 as a thank you when she goes back to work in two weeks, but Stacy-Ann changes her mind due to an onslaught of bills that accumulated while she was off of work for a month. (10 marks)
9. Susan, an avid online shopper, was bidding on a Louis Vuitton handbag on eBay. Up to the time the auction was about to end, she was the highest bidder, until suddenly, the auctioneer removed the handbag. Susan decided to sue the auctioneer. With all her online shopping sprees, Susan forgot to pay the credit card bill. Royal Bank contacts her stating that they will accept part payment of the bill, which she pays. One month later, Royal Bank calls Susan asking for the outstanding balance. Susan refuses, stating that they had a contract to pay part of the debt. (10 marks)
10. Marcia goes to buy Candice’s house. Candice’s dog did a lot of damage to the house, so she painted it to cover the damage and Marcia buys it, only to find out later that there is substantial damage. (5 marks)
11. Gary meets Shanice M., who lives in New York and decides to move and sell his business as a going concern to Sabrina and Marisa He says that the company is doing fine, even offering to show them the books, but in reality, the company had been operating at a loss for the past 3 weeks. Sabrina and Marisa refused to look at the books, deciding that Gary was a trustworthy man. One month later, they reviewed their accounts for June, and realised that Gary was dishonest. Gary says, “You had a chance to look at the books yourself. That’s not my fault!” (10 marks)
12. Shanice M. and Lance want to build a swimming pool in their yard. Jhalisa, the owner of a local contracting business presents the couple with a contract that lists the specifications for the pool: i.e., length, width and depth. It also includes a description of the materials to be used, a tentative schedule for the project and the price. Thinking the price is a little high, Lance crosses out the price and scribbles in a price that he thinks is reasonable and then both he and Shanice M. put their signatures next to Jhalisa. When Jhalisa sees the changed price, she walked away without saying a word and never came back. Lance wants to sue for a breach of contract. (5 marks)
