The Crime Control model represents teleologic, "ends" based policing. The Due Process model represents deontological, "means" based policing. The entire criminal justice system is geared toward teleological, "ends" based policing, from police officers to district attorneys to judges, because it is the most efficient and cost-effective way to implement justice. However, "ends" based policing and prosecution run contrary to the Constitution of the United States. However, the consequences of lying during arrests and court testimony weigh more on police officers. District attorneys and judges cannot be sued for the "ends" approach, but law enforcement can. The punishment for a lying officer can be suspended without pay, loss of credibility within the agency, courts, and the public. Lastly, officers found to be dishonest may be placed on a "Brady List." A "Brady list" is a list that prosecutors use to keep track of police officers who have engaged in or have been accused of misconduct.
The Due process model of policing is ideal, but the Crime Control model is practical, and it is the model that works. The criminal justice system is funded by the taxpayers (citizens). The citizens expect a return on their investment. This will not occur by letting criminals go free because of due process issues, or the possibility of a 50% chance on an expensive jury trial. Meanwhile, district attorneys and judges rarely face the same consequences for the same conduct.
