As we’ve learned this week, “voluntariness” is the pivotal prerequisite for valid consent. Describe the factors which the courts examine when determining whether or not consent is voluntary. Provide a scenario, real or fictional, demonstrating a circumstance in which consent to search is NOT voluntary. As you respond to classmates, consider how you might change the scenarios to render them voluntary, taking into consideration the factors discussed here.
