Module 2 – Social Change
SS 2800
Module 2, Social Change
Criminal justice is the societal issue that needs to be addressed in today's society. The criminal justice system's organizational structure needs to be changed. Reform is required in the fields of rehabilitation, incarceration, and sentence. The entire society is impacted by the criminal justice system. In addition to the fact that incarceration costs taxpayers money, it can be viewed as a negative because formerly jailed individuals frequently struggle to reintegrate into society.
Problem in Sentencing
Regarding sentencing, there are a few aspects of the criminal justice system that require improvement. First, the laws pertaining to mandatory minimum punishment need to be changed. Regardless of the specifics of the case, these rules mandate that a person be sentenced to a specific amount of years in jail. Unfair sentences or sentences that are excessively severe for the offense may result from this. Reforming the way parole is administered is also necessary.
The act of releasing a prisoner before the conclusion of their term, typically after serving a specific proportion of their sentence, is known as parole. However, in some places, parole is either not available for specific crimes or is decided by a board that may have prejudices against the inmate. Unfair sentences and the retention of inmates long after their term has been served are possible outcomes of this.
Problem with Incarceration
The criminal justice system has to be reformed in a number of ways related to three incarcerations. One of the problems is the large number of Americans behind bars. The United States has the highest incarceration rate in the world, according to the Prison Policy Initiative (Visher, C., et al, 2022). This is due to a number of factors, such as the implementation of mandatory minimum penalties and the War on Drugs. The way people are imprisoned is another problem. For instance, a large percentage of people are imprisoned in private prisons, and people are frequently imprisoned for nonviolent crimes. In addition, there are insufficient education and rehabilitation programs in prisons, and inmates are frequently imprisoned for extended periods of time.
Problem with Rehabilitation
The criminal justice system has to be reformed in a few areas related to rehabilitation. One solution is that more rehabilitation opportunities must be offered by the structure. This might be accomplished by expanding the number of rehabilitation programs that are offered or by improving the programs' accessibility. Increasing assistance for individuals attempting to rehabilitate is another way that the criminal justice system has to be reformed (Visher, C., et al, 2022).
This could entail increasing funding for rehabilitation initiatives or offering additional assistance to people reentering society following their release from prison. Last but not least, the criminal justice system needs to be reformed by making punishments for minor infractions and misdemeanors more easily accessible. Rehabilitation and programs can be the answer here, rather than institutionalizing someone who might end up joining the system by spending time with actual criminals who will mistreat them and turn them into a criminal.
Impact and Resolution on Criminal Justice System
The issue stems from the criminal justice system's inability to effectively reduce crime and rehabilitate offenders. In addition to being costly and ineffective, the system negatively affects the lives of offenders and their families. A person's behavior, attitude, and demeanor change after they enter an institution for a lengthy sentence; they will no longer emerge as normal. This shift will have an impact on the individual for the remainder of their life, eventually becoming a part of the institutional cycle. Relearning to be good after it has been lost is more difficult than unlearning to become institutionalized. There are numerous reasons why sentencing, jail, and rehabilitation aspects of the criminal justice system require reform. The following are a few possible causes:
· A War on Drugs
· Racial disparities in sentencing
· Overcrowding in prisons
· Mandatory minimum sentences
· Racial disparities in sentencing
· A lack of funding for rehabilitation programs
Since the criminal justice system can be altered in a number of ways based on the unique demands of a community or nation, there is no one-size-fits-all solution to this subject. However, some recommended reform areas include investing in community-based policing initiatives to strengthen the bond between law enforcement and the public, expanding the availability of rehabilitation and re-entry programs to assist offenders in reintegrating into society, and updating sentencing guidelines to ensure that punishments fit the crime.
