Scenario
ABC Medical Center (ABC) is a midsize hospital that receives federal research funding. As a federal contractor, ABC is required to maintain an affirmative action plan (AAP) under Executive Order 11246. A recent OFCCP audit revealed underrepresentation of women in certain supervisory positions, including areas of patient care involving intimate medical services. ABC was instructed to review its recruitment and promotion processes and ensure that qualified individuals were receiving fair consideration.
A supervisory role in the Obstetrics & Gynecology (OB/GYN) unit became vacant. Two internal candidates were selected as finalists:

After interviews, ABC promoted Applicant B. Internal emails among decision-makers stated that:
