After screening, the company disqualifies a finalist due to a nine-year-old misdemeanor theft conviction, even though the role involves no handling of cash or inventory. The applicant files a complaint alleging improper screening practices.
In your initial post, address the following:
· Which parts of the company’s screening process raise potential legal concerns under federal law?
· Would the physical ability test be defensible as job-related and consistent with business necessity?
· Would the criminal record exclusion likely survive disparate impact analysis under Title VII?
· Could the employer face negligent hiring liability if it failed to run these checks—or are the checks excessive for the job?
· What changes, if any, should the employer make to its screening procedures to ensure both compliance and reasonable risk management?

1. Using this week's readings and/or any additional existing knowledge or research on the "Impending Crisis" to borrow from David Potter's most excellent and important book, I would like for you to use the following scenario question to frame your main answer post for the first of two parts in this week's discussions: If you were asked by a student or one of your peers to choose only one "cause" that led to the American Civil War (i.e., one reason why the war happened), how would you answer your student or peer and why? NOTE: I would ask that you choose only one reason even though strong arguments can be made that trying to choose one is folly because I want you to continue honing the skills of making a focused argument within all academic writing, whether for the HIST 698 Comprehensive Exam course or HIST 699 thesis capstone course, at the end of your degree program.
2. Within the same body of the response you make to the writing prompt in Part One above, I would ask that you pose a question to your peers regarding any aspect of the Civil War Era in American history (i.e., any question from the late Antebellum, Civil War, or Reconstruction periods). NOTE: Remember that your question should be academic in nature and be bent toward delving into the history of the period.

In this week’s readings and resources, you learned about various types of sculptural techniques. This discussion has three parts:
1. Create a sculpture using one of the sculptural techniques you learned about this week. For example, you could stack stones to create a work of land art, carve a bar of soap to create a sculpture, or use materials you have around you to create an assemblage. The options are limitless! Put some thought into your work and try to create something that might communicate a message.
2. In your initial post, share a photograph of your sculpture. Explain your process for creating your sculpture. What technique did you use? How is that reflected in the sculpture? Use artistic vocabulary presented throughout this lesson—and throughout the course—to describe your sculpture. Don’t be shy—we are all beginning artists!

2. Make an initial post telling the class about how many acts of violence you counted during the video. After stating your witnessed number, explain what you considered a violent act in the video.
3. Keeping in mind your answers above, provide a clear, concise definition for violence that should be used when watching the video.
4. The likelihood is that we will have many different numbers for the acts of violence that each of us witnessed during the video. Considering that the likelihood is that we will see different counts in the class, this means that we may have different ideas and definitions for what we consider violent acts which illustrates the importance of conceptualization and operationalization. This also means that if we are using different definitions for key elements of a given research question, we would not have high inter-rater reliability. So, what does that inform us about the types of research we have been learning about throughout this class? How might unobtrusive measures be effective in data collection? When might they be ineffective?
