The following Case Study comes from Chapter 11 of your textbook:

As reproductive technology advanced, headlines announcing “Couple Battles over Frozen Embryos” became more and more commonplace. For example, in the 1980s, a man went to court and succeeded in preventing his ex-wife from using their frozen embryos to become pregnant. He maintained that after he and his wife had divorced, he no longer wanted to become a parent and should not be forced to do so against his will.

In 1998, a divorced woman in New Jersey won a legal battle with her ex-husband over custody of seven frozen embryos the couple had created in vitro while still married. The wife wanted to have the embryos destroyed, while the ex-husband argued his right to adopt his own embryos to be implanted in a future partner or donated to a couple with infertility.

And in 2016, a famous actress was sued by a right to life group who wished to obtain her frozen embryos that were part of a divorce battle.

In your opinion, should frozen embryos be considered property to be awarded during a divorce? Why or why not?

Should a man who loses custody of frozen embryos in a lawsuit be responsible for child support if his ex-spouse is implanted with the embryos and becomes pregnant at a later date? Explain your answer.

Anti-discrimination law often hinges on determining how an employment decision was made. Sometimes intent matters; sometimes it does not. This week focuses on analyzing workplace decisions using the disparate treatment and disparate impact frameworks.

Consider the following scenario:

A logistics company revises its hiring process for delivery drivers by implementing a written aptitude test focused on spatial reasoning, pattern recognition, and processing speed. After six months, HR discovers that pass rates for applicants over age 50 are significantly lower than for younger applicants. A rejected applicant age 58 files a complaint alleging age discrimination under the ADEA, arguing that the test disproportionately screens out older candidates and is not truly related to job performance.

The employer defends the test by stating that quick processing speed “helps with route efficiency” and that the assessment is “standard in the industry,” though no formal validation study has been conducted.

In your initial post, discuss the following:

• Would      this claim be better analyzed under disparate treatment, disparate impact,      or potentially both? Explain.
• What      evidence would the applicant need to establish a prima facie case?
• What      must the employer show to defend the test as job-related and consistent      with business necessity?

Using the Google Arts and Culture website, select a painting, sculpture, print, or photograph that captures your attention. Identify the work of art by artist, title, date, and medium. Then, discuss how the artist used at least 3 elements of composition or principles of design to create the work of art. Incorporate artistic vocabulary and key terminology from the module. Finally, identify the element or principle you feel is the most difficult to identify.

Using the skills you learned in weeks 1 and 2 evaluate a set of statistics.  An Excel spreadsheet is attached including 30 data sets representing the height and weight of 14 year old boys.  The first column is the height in inches and the second the weight in pounds.  Choose one data set that has not already been selected (include the number of the data set in your title to make this easier to do).  Calculate the mean, median and mode of the weights in the data set.  You can either do this by hand or see the video below to show you how to do this using the tools in Excel.  Then, explain what these numbers mean.  Are they the same?  Why are they different?  

Then, construct a scatter plot.  

• From      the insert menu select scatter or the chart that says scatter and then      select the chart at the top left on the dropdown
• Click      on one of the points
• Select      Add Trendline (Note you may need to add Trendline and then click on the      line to format Trendline) 
• The      default radio button is linear, keep it checked

What are your observations from the scatter plot?  Does it appear that there is a correlation between the height and weight of 14 yr old boys.  Note:  this data is made up, so do you think this is accurate?  Do you think given real data that there would be a greater amount of correlation or less?  
