Understanding whether a worker is an employee, an independent contractor, or an agent is often the first and sometimes the most important step in an employment law analysis. Misclassification can expose employers to liability ranging from back pay to vicarious liability for wrongful acts.

Consider the following scenario:

A home-maintenance company contracts with a handyman named Victor to perform repair services for residential clients. Victor wears a company-branded shirt, drives a van with the company’s logo, and receives all his assignments through the company’s scheduling app. The company prohibits him from accepting outside work and requires him to follow detailed instructions for each job. One afternoon, while driving to a client’s home, Victor negligently hits a pedestrian. The pedestrian sues the company, alleging that Victor was effectively an employee or agent and that the company is vicariously liable.

In your initial post, address the following:

• Based on the facts, how would      a court likely classify Victor: employee, independent contractor, or      agent? Why?
• What factors in the scenario      most strongly support or undermine a finding of employer control?
• Would the company be exposed      to vicarious liability for Victor’s accident?
• How might the company      restructure or clarify Victor’s role to reduce future classification and      liability risks?
• What additional information      would help determine whether misclassification occurred?
