Case Study Research Paper - Group Submission

Group Case Study Assignment

Assignment: Provide a written collaborative analysis of the assigned case study.

When students are presented with a case, they place themselves in the role of the decision maker as they read through the situation and identify the problem they are faced with. The next step is to perform the necessary analysis—examining the causes and considering alternative courses of actions to come to a set of recommendations.

1. Students should read and reflect on the case.

2. Meet in their learning teams to discuss their findings with other classmates.

3. Working together, question and probe the underlying issues.

4. Compare different alternatives (possible course of action for management)

5. Suggest one or more specific courses of action from the possible actions identified above, in light of the organization's objectives.

6. Provide a justification of your decision.

My role as your professor is to watch as case studies unfold, make observations and ask questions. At the end of the class, you'll be amazed at what you learn from exchanging ideas with your classmates.

Requirements:

· There is no minimum or maximum required number of pages. Your analysis will be considered complete, if it addresses each of the 6 components outlined above.

· Use of proper APA formatting and citations. If supporting evidence from outside resources is used those must be properly cited. A minimum of 7 sources (excluding the course textbook) from scholarly articles or business periodicals is required.

· Include your best critical thinking and analysis to arrive at your justification.

· Approach the assignment from the perspective of a qualified attorney.

Submission: Upload/attach your completed paper to this assignment by the due date.

Around 5:00 a.m. on January 1, 2004, Matthew Schmucker, who was 18 at the time, was traveling alone in a horse and buggy near the intersection of Indiana State Road 37 and Notestine Road in Harlan, Indiana. He was intoxicated at the time and failed to stop at an intersection, thereby colliding with the side of a 2003 Dodge Stratus carrying David Candon and Monica Young, who is now paralyzed from the neck down as a result of the accident. Schmucker was charged with being a minor in possession of alcohol and failing to stop at a throughway. Candon, Young, and their children, who were in the car at the time of the auto/buggy collision, brought suit against Schmucker. Schmucker declared bankruptcy and asked to be discharged from his obligations to Candon and Young. Candon and Young argued that the injury was a “willful and malicious injury by a vessel” under the bankruptcy code and was thus a nondischargeable debt. Schmucker said a horse and buggy is not a vessel.

Discuss the role of the court in this case.

What would the court look to in making its decision?

What is the impact of the court’s decision on the ability of the family to recover for injuries?
