Read the scenario below.

Mario Gonzalez, 34 years old, was just convicted on misdemeanor sexual assault charges, for

improperly fondling a child. This is Mario’s first conviction for a criminal offense. His pre-sentence investigation report shows a prior arrest for driving under the influence of alcohol, but was dismissed for a procedural error on the part of the arresting officer. Additionally, Mario admitted to have been drinking when he fondled the child. 

1. What type of sentence you would give the defendant based on the details provided.
2. Detail the length of incarceration you would set, or provide an alternative sentence, such as probation with specific terms.  Explain your rationale.
3. What other types of information would help you make a more informed decision on sentencing?
