Discussion Question 1

Often, there are rearrangements in the administrative agencies handling immigration laws. Recently, the USCIS (United States Citizenship & Immigration Services) functions were transferred to other administrative agencies. Do you think the changes were made because there are problems in the agency management or because the laws leave too much room for different interpretation? Do you think the objective of the rearrangement has been met? Discuss giving two examples and scenarios to support your answer. Research the Internet to provide reasons for the restructuring.

After a relatively open-door policy early in its history, the U.S. immigration laws became stricter in the 1920s, when Congress “closed the door” on immigrants. In 1965, it relaxed the restrictions and let more people enter the U.S. Use Westlaw to research the relevant legislation. Keeping historical events in mind, provide reasons for such a shift. Should the U.S. be consistent and strict about enforcing immigration laws? Support your answers with quotes from legal authorities. Do you agree with the idea that the Chinese Exclusion Act is constitutional? Read the case Chae Chan Ping v. U.S., and support your views with legal authority.
