Feedback for Project 2: Making Decisions That Are Legal and Ethical

Turnip Plaza milestone: you have a basis here on which to build for revising for final submission. First, 10 page limit on text per instructions. Second, stick to the learning resources in the classroom. Your use of outside resources and case law is not helping. Third, your first paragraph of paper adds nothing. Delete it and in its place have a paragraph that summarizes the facts of the case (as I have said repeatedly in the classroom and emails always start with a summation of the facts). Cite to the case facts at the end of summation. Fourth, on legal theories Mark will assert, your organization is off. You start with the basics and build from there. Define, cite, apply every time. You do not talk about this case enough. You have some of the info you need for this section but the organization is out of whack. Mark will first say there is a breach of contract. For there to be a breach of contract there has to be a contract. So you start with the elements of a contract -- offer, acceptance, consideration, meeting of the minds. Here you try to start in the middle with consideration. Once you go over the elements of a contract, you need to analyze whether the contract needs to be in writing (called the Statute of Frauds). Then alternatively, Mark would assert promissory estoppel. So that is the logical flow of Mark's claims. Fifth, on remedies, discuss the various monetary remedies using the learning resources, but then you need to talk about non-monetary remedies (such as performance, which is in the learning resources). Sixth, your ethics section is just about ethics. No law talk, such as agency. Legal in legal section, ethics in ethics section, and bring the two sides together in the conclusion. So focus on the tests from the learning resources -- define, cite, apply. Finally your conclusion. So again, a basis here but lots of reorganization and some expansion but also some deletion of material. Let me know if you have questions.

Additional: First paragraph just summarize. Legal history: talk about what is contract offer and put concept first. Rearrangement is needed and make it more logical. Damages: use learning resources. USE ONLY LEARNING RESOURCES, NO OUTSIDE SOURCES.

Carz report final submission: this needs substantial revision in order to pass. You have one opportunity to resubmit before Feb 13 resubmit deadline. If you would like a phone conference, let me know. Suggest you re/read Jan 15 guidance email and announcements about this deliverable and sourcing. First, formatting. Too many headings. Just have intro, arguments for plaintiff, arguments for defendant, and conclusion. Here all the headings makes for choppy writing and does not show how one legal concept flows into the other. The intro is just a summation of the case facts, nothing else, with a cite to the case facts at the end of summation, and put case facts in reference list. And page numbers on all reports please. Second, sourcing -- as I've said before you must rely on the learning resources in the classroom. Your outside research has lead you down a rabbit hole and you are not focused on the issues you need to be focused on. Third, you have to talk about both Wilson and Mitchell as both are equally important. Fourth, in Arguments for P and then D, these are the main sections of your paper. You must be methodical. One legal principle per paragraph; define, cite, apply (DCA). Every time. If you are not doing that, you are not adding to the legal analysis of your paper. In P, start with what is agency; DCA. Second paragraph, general v limited agency; DCA. Then you can go on to concepts like vicarious liability, respondeat superior, duty of care, etc. One principle per paragraph; define, cite, apply to Wilson and Mitchell. Once you finish P side, then you move on to D side with same methodical approach. Finally, the conclusion is a brief summation of each side's argument without deciding the case. USE ONLY LEARNING RESOURCES, NO OUTSIDE SOURCES.
