Discussion Question 1- Case Law That Shapes Officer Actions

Case law decisions are critical in shaping how law enforcement does their jobs.  These are decisions made by appeals courts based on cases that come before them.  Choose a criminal case law decision that interests you and that you believe would interest the class.  Discuss what happened in the incident that led to the case law decision, what the decision was, and how the decision has shaped officer actions on the job.  Examples of case law decisions to consider include:

  • Miranda v. Arizona (interview and interrogation rights)
  • Any other decision that was created by Miranda decision (lots of those)
  • Tennessee v. Garner (fleeing felon rule)
  • Graham v. Connor (objective reasonableness of use of force)
  • Terry v. Ohio (stop and frisk case law)
  • Minnesota v. Dickerson (plain feel rule for Terry stops)
  • Mapp v. Ohio (evidence exclusionary rule)
