Businesses, Religious Discrimination & the Law
The Supreme Court has ruled on a number of occasions that businesses must conform to anti-discrimination laws and not discriminate in the offering of services on the grounds of race, gender, religion.
On December 5, 2017 the US Supreme Court heard the case Masterpiece Cakeshop v. Colorado Civil Rights Commission.
Research the case and the arguments that were made by both sides in their appearance in front of the court.
Write a response of approximately two to three pages excluding reference and title pages (750) words to the following questions:
- What are the constitutional issues that both sides are raising? Explain these in your own words. Do not copy from the court transcripts.
- Summarize the arguments that both sides made to support their case. Again, put in your own words; do not just copy from the court transcript.
- If you were a Justice on the Court, which side do you believe has the stronger constitutional case and why? Remember that the Justices are suppose to be objective and not bring their own personal religious and social beliefs into their decision-making.
