The case of Kraft Foods sued TC Heartland in the District of Delaware they alleging that Heartland’s water down their liquid to enhancer the products to infringe three of Kraft Foods’ patents. The Heartland moved to try to dismiss the action or transfer venue to the Southern District of Indiana, where they are a station at and incorporated. In their support, Heartland stated that they is not registered to conduct business in the state, Delaware. On the other hand, the district court had denied it’s their motion for Heartland to be granted an appealed. Meanwhile, the Federal Circuit stated that patent suits may be filed in any judicial district in which a defendant can sell an allegedly infringing product to whomever as long as they are of age. The Heartland said that they only shipped 2% of the total accused products to Delaware. Retrieved from
