Please read this recent article from SF Business Journal.  Obviously, the case is pending, and unless it settles, much of the outcome will depend on the proofs of claims -- the actual evidence offered by both sides.  So, we needn't take a position on liability at this early date, BUT how many legal issues can you spot in this situation?
