question
Discuss the steps an employer should take to develop and implement its policy regarding employment-at-will?
Student response
According to Heneman, H., Judge, T. & Kammeyer-Mueller, “employment-at-will involves the right of either the employer or the employee to unilaterally terminate the employment relationship at any time, for any legal reason” (2019, p. 635). Some steps that organizations can take to develop and implement its employment-at-will policy are:
- Ensure to not state a time period for employments, there should not be a definite time or date an employee will be in the organization so when employers decide to let an employee go a lawsuit is not in their future.
- Another step a company can take is to verify that documents i.e. employee handbooks, job offers, and manuals indicate clearly employment-at-will and any implication of long-term employment needs to be removed. Current employees need to be trained as well as to shy away from making any statement regarding employment.
- A clear concise disclaimer regarding employment-at-will should be discussed and in writing signed by the candidate upon the employment offer.
