Course Resources
This course surveys the legal environment of the health services industry from a policy perspective, with emphasis
on the tensions and trade-offs between quality and cost. The course uses case law, statutory and regulatory
analysis, and trends in health services delivery law to focus on the overall legal relationships among physicians,
personnel, patients, and health care institutions. Topics include access to health care, antitrust law, personnel
licensure and institutional accreditation, malpractice, professional and institutional liability, cost containment
regulation, and cost controls in government programs. The course also discusses the philosophical and
managerial implications of ethical issues including professional codes, resource allocation, and decisions
concerning impaired professionals, end-of-life decisions, experimentation, and biotechnology.

Introduction
The health law field currently has undergone, and will continue to undergo, enormous change. Among the
multitude of challenges are legal implications that come with electronic health records (EHRs), payments based
on patient outcomes, mergers, fraud, insurance disbursements, and antitrust laws—just to name few. In addition,
disruptive medical innovations, such as biotechnology and treatment research, have created new concerns over
ethics and privacy.
To perform proficiently as a health care administrator, the current environment requires that you have an
understanding of key health care laws such as the following:
Stark Law.
HIPAA for Professionals.
HITECH Act Enforcement Interim Final Rule.
Emergency Medical Treatment & Labor Act (EMTALA).
A Roadmap for New Physicians: Fraud & Abuse Laws; Anti-Kickback Statute.
The Genetic Information Nondiscrimination Act of 2008.
Instructions
In this assignment, imagine you work as an administrator in a hospital or health care organization. You are being
considered for a promotion and are being asked to prepare a report for senior leadership that demonstrates your
knowledge and interpretation of one of the above-mentioned health care laws.
To complete this report, select a court case where one of these health care laws was violated. Write an analysis of
the law and the selected case following the SESC formula: State, Explain, Support, and Conclude. Be sure to also
address how organizational leadership in the selected court case could move forward to ensure that the health
care law isn't violated again in the future.
Your report should be at least five pages long and should include a title page and references for a total of 7–8
pages.

Introduction
Organizational policy alignment and adherence to laws and regulations is critical for overall corporate compliance
and to decrease organizational risks (patient falls, medication errors, cyber hacks and PHI data breaches,
infection control, et cetera). In this assignment, you will select, evaluate, and update one health care provider’s
policy related to a significant regulatory risk to the health care organization.

Select one of two options:
Option A
If you work for a hospital or health care organization you may select a policy that is of interest to you then follow
these assignment instructions:
Imagine you are a health care administrator at your current employer. Analyze the policy you selected,
taking into consideration any recent changes. Evaluate what information and where that information would
need to be updated. Propose revisions that are based on current identified standards and/or new guidelines
that you have researched in the text or identified in other high-quality sources (that is, journals, government
websites, and the like). Analyze the significance of the selected policy updates as it relates to potential
litigation. (Why did the policy need updating? What threats do these changes help avoid?) Summarize your
perspective on the revisions as well as any additional changes that should be considered. Present your work
as an executive summary suitable for distribution to your organization’s board members.

If you do not work in the industry or do not have access to a health care policy, use the Hahnemann Falls Policy
to complete this assignment. Then follow these assignment instructions:
As you can see, this policy was written in 2012. Now, imagine you are a health care administrator working at
the health care organization where this policy originates from. Analyze the policy, taking into consideration
the changes in HIPAA and PHI since 2012. Evaluate what information and where that information would
need to be updated for a current revision of this document. Locate the areas where you would update or add
information to this 2012 version. Propose revisions that are based on current identified standards and/or

we have already discovered, there are important interactions between ethical behaviors and legal issues. Health
care administrators need to understand the relationships as well as the distinct differences. Health care
institutions have ethics committees that play a central role in the protection of patient’s rights, the organization as
a whole, and its staff.
Instructions
Imagine you work as a professional health care administrator in a large medical center. You have been asked to
present a paper at a professional conference on medical ethics and caregiver-patient encounters. You must write
a paper about a significant physician-patient ethical dilemma in a medical setting, defending the decision and
conclusions made.
