1. If a state abolishes the insanity defense, is it violating the U.S. Constitution?
Some legal experts believe the Constitution allows each state to establish its own criminal laws
while other legal experts say that doing so, they are violating legal precedents and moral norms.
My major is Psychology. This argument relates to my field of study because the criminal has to
submit to a thorough psychiatric evaluation to be considered “legally insane”.
