Do the prison conditions contribute to sexual assault and violence in
prisons?
In the past, women and girls have been affected by rape and sexual assault
at relatively low rates. Of 63 reports, 63 led to arrests. Out of those, 13 faced
charges. For felony convictions, it was found that 99% of many of the
offenders were behind bars.
The Bureau’s Survey 2012-2020 reveals that 12. 2 percent of non-
heterosexual persons in prison said that they were subjected to inmate-on-
inmate sexual assault in the last 12 months, while 1. 2 percent of
heterosexual inmates also reported the same in the case of staff-on-inmate
sexual assault.
Of non-heterosexual prisoners, a significant percentage reported assault,
compared to 2.1 percent of heterosexual inmates.

Male-on-male rape has long been criticized. A minority of one out of every
ten male-male rapes is documented. Male rape victims, as a group, claim a
lack of resources and reinforcement, and court systems are not well-
equipped to deal with this crime.
Studies show understanding that there are types of rape, that include
prisoner rape where it's found that there is male-on-male and female-on-
female sexual assault in prison. Telling us that the rate of male rape is higher
in the LGBT and collegiate communities for instance. A review of the
literature shows that prisoner rape especially the male-on-male type and the

female-on-female type of rape is a common form of rape that is reported
even less than rape that occurs in the community.

Contribution of Sexual Violence
Sexual violence in prisons is influenced by many different factors.
Overcrowding, inadequate staff training, and a lack of resources for
rehabilitation. The ranked nature of prison culture can also contribute to
power imbalances and the normalization of violence among inmates. The
lack of oversight and the isolation of victims make it difficult to report abuse.
They need help addressing these issues and it requires systemic reforms,
better staff training, and increased mental health support for both inmates
and staff.
Federal Policies Created
During the time of President Obama, several federal policies were added to
the system. The enactment of The ‘Smart Foster on Changes Crime’ in
planning the prison to decrease the extreme sentences for non-violent
offenders and shift the focus from punishment to rehabilitation. The Obama
administration was also perceptive in addressing the issue of the racial Grant

Federal Policies and Prison Conditions
Creating the First Step Act, mandates the A.G. (Attorney General) to come up
with a risk need assessment tool BOP (Bureau of Prisons) that should be used

to assess the risk of reoffending and the scientific study of criminals' needs
of all federal prisoners and to put the prisoners in programs and activities
that can help in the manage the prisoners’ needs, towards the reduction of
the risk of lapsing.
