Kathy was asking the court to overturn a will that Ralph agreed to
with an attorney. While Kathy argued that Ralph wasn't at a clear
state of mind when he agreed to the will she failed to provide
convincing evidence otherwise. Instead, Kathy used the testimony of
a doctor with conflicting testimony of Ralph's dementia. There was
also a witness to Ralph's clear state of mind adding validity to the
original will. In the end Kathy's argument of fraud lacked solid
evidence and she stood to make the financial gain for disputing the
existing will.
a a The court did its due diligence in requesting the person claiming
the existing will should be overturned to provide proof of her story.
Kathy had everything to gain from overturning the will written by an
attorney. There was also evidence to suggest Ralphs mental capacity
may have been compromised while he was in the nursing home with
Kathy. It seems that the more logical a decision was for the judge to
follow Ralphs original wishes that was confirmed by a witnesses with
no personal benefit in the will.
