Case Analysis 1: Case 3-4 Murphy, Governor of New Jersey et al. v. NCAA et al.
Introduction
New Jersey is proposing to legalize sports gambling at casinos, which is forbidden under
federal law and protection for professional and amateur sports. This case includes sports
gambling. The court concluded that the Professional and Amateur Sports Protection Act (PASPA)
violates the tenth amendment and cannot be enforced. Prior to the court rulings, gambling was
only legal in Nevada. The Supreme Court's decision to allow states to act on matters not
governed by Congress (Spitz, Terry, 2020) marks a significant shift in the American sports
business. Nevada was the only state that authorized sports betting.
Issue
After reading the case, the first issue that occurred to me was gambling addiction. The
primary ethical issue in this instance was gambling addiction. Professional leagues face
challenges in controlling the participants involved in these bets. The NCAA does not allow
betting or gambling, but it can be challenging to monitor those who do. According to Smith
(2020), there are approximately 460,000 NCAA players in America. However, there is currently
no system in place to monitor sports betting participation. It is difficult to track NCAA athletes
who participate in these activities. Athletes must prepare for their performance by completing
numerous chores beforehand. Identifying the root cause of poor performance can be challenging
due to a wide range of factors. The same goes for gambling game addiction. Addiction is
unpredictable and can devastate your life at any time. Gambling addiction can lead to negative
emotions and mental health issues. Some individuals have committed suicide due to financial
difficulties in repaying loans from banks or other lenders.
3
Allowing gambling raises the possibility of other states following suit, further
complicating the situation. Betting and gaming generate major financial benefits for the state.
Other states are considering legalizing gaming to increase tax income. According to Champion
Jr. et al. (2020), PASPA violates the theory of command and control by limiting state legislatures'
authority. According to Champion Jr. et al. (2020), the suggested theory modifies a fundamental
idea of federal law while acknowledging congressional power limitations.
One issue I identified was the belief that legalizing gaming would reduce crime. Allowing
sports betting was thought to assist the US economy by increasing exports. Opponents of sports
betting argue that permitting it will lead to young people investing all of their savings. The four
major sports organizations (NBA, MLB, NHL, and NFL) shape the sport's interest and morals.
These groups will shape where our sports community goes in the future.
Options
Sports gambling is a complex issue, with some customers supporting it and others
arguing for its economic benefits. People in this circumstance are unconcerned about politics;
their only worry is whether or not state money will increase. They prioritize governmental riches
and revenue before personal enjoyment. Many people suffer with sports betting and other types
of betting, but these difficulties are often not discussed. Another option is to legalize the pursuit
of criminals or illegal gamblers. Supporting individuals battling gambling addiction is another
option.
There are a number of intriguing, strange things going on in this case. For example, even
non-sports enthusiasts gamble. Sports betting can provide leagues or organizations with a second
stream of cash. Professional leagues take integrity fees from gambling revenue to fund their
4
organizations, except for the NCAA (Spitz & Terry, 2020). Sports betting has gained popularity
among new players who believe that betting a certain amount of money increases their interest in
watching the event. Additionally, it may boost media consumption, generating cash for the
government and sponsors.
Ethical Arguments
Maintaining ethical control in this situation will be difficult. On the other hand, this case
is more appropriate for the case's lesson. Maintaining the integrity of matches will be tough at
the beginning. Gambling is ever present. Therefore, there must be some illegal and inappropriate
behavior. Despite these difficulties, people continue to gain money through betting. Gambling
can destabilize families and lead to significant troubles for those involved. Sports gambling can
be hazardous for a variety of reasons, but it is especially harmful for persons with mental health
issues who engage in games or betting. Sports gambling entails disrespecting athletes, spectators,
and team fans. Returning money to the state or society is also morally imperative.
To address the issue of gambling, individuals should examine moral and ethical norms,
rather than relying solely on businesses and organizations to profit. The focus on profiting from
betting and gambling sometimes overlooks the mental health issues that individuals may have as
a result. People prioritize financial gain over moral values. Profitable activities must be
inherently beneficial. This has been the situation for several decades. As a Christian living in the
world, I strive to live a life worthy of the label "child of Jesus" by considering the bigger picture
in all I do. "Give to the one who begs from you, and do not refuse the one who wishes to borrow
from you" (Matthew 5:42). According to Matthew 5:8, those with a pure heart will be blessed
with the opportunity to see God. Understanding that Jesus is our rescuer and that our actions will
5
be judged by Him is crucial for survival. Those with the right hearts recognize the need of
serving others, just as Christ serves us.
Conclusion
Finally, it's important to analyze all available options before acting. As Christians, we
must see the bigger picture of our world, which does not revolve around money or earning a
certain amount every day or hour. As Jesus served his fellow man, so should we. The issue that
may eventually lead to sports betting or other types of gambling speaks for itself. Honesty is the
only thing that can bring people together, regardless of their athletic background. Maintaining
fairness and honesty is crucial for sports, making them appealing to spectators. If I were to argue
against legalizing gambling, I would present facts and examples of how it has negatively
impacted the mental health of individuals and families. Footballers and athletes have a
significant impact in inspiring others. Sportsmen often inspire young children to participate in
sports. However, legalizing gambling may remove this incentive. Parents are hesitant to
encourage their children to pursue professional sports now that gambling is legal. Legalizing
gambling may cause psychological harm to those who have previously suffered with it, leading
to opposition from the public. We should act morally when we have the ability to do so, as we
will be held accountable for our actions now and in the future.
