Mark Cuban was accused of insider trading relative to his investment in
Mamma.com. Securities and Exchange Commission v. Cuban, 620 F.3d 551
(5th Cir. 2010). What would you have done in his situation? Do you think he
did anything wrong? Is insider trading wrong anyway? What does the Bible

INSIDER TRADING
Insider trading is using non-public information obtained by virtue of one's position in a
corporation to trade. This is deception. It is prohibited since it is against the expectations of
shareholders (Roger. 2020). Insider trading is unethical since it seeks to promote the benefit of
one individual. However, if I were in Mark Cuban’s position, I would have done the same. I
would have sold Mamma.com’s shares. Certainly, I would not wait until the company sells its
shares at a price below the market price. If I waited for this, I am the one who would have made
the loss. Although it is clear that the information which Cuban used was non-public information,
his action does not amount to insider trading. Essentially, Cuban was not in any position in
Mamma.com. He was just a minor shareholder. Although he was a friend to Mamma.com’s
CEO, he is not the one who looked for the non-public information that he traded with. Moreover,
CEO did not give Cuban the information he gave him so that he can trade with it. Certainly, what
Cuban did is what any reasonable shareholder would do if, in any way, he or she senses that his
or her interests are at risk (Roger. 2020). Thus whatever he did was not wrong. However, insider
trading is wrong since it benefits one person at the expense of others. Bible forbids insider
trading. According to the bible, insider trading is wrong. This is because it makes an individual
gain wealth hastily. Bible says that wealth gained in such a way shall dwindle easily. It is better
to get little wealth in the right way that will increase. Therefore, this case is within the biblical
jurisdiction of the civil magistrate.
