Research Paper: Religious Freedom Preparation Assignment
Thesis Statement
One’s rights may be defended as long as those rights do not infringe upon another’s.
Infringement of someone’s rights based on a disagreement is unconstitutional.
Direction
This paper will examine the facts of both Obergefell v. Hodges and Masterpiece Cake
Shop v. Colorado Civil Rights Commission. This paper will also discuss, breakdown and analyze
the legal questions, judicial opinions, rationale and corresponding case law pertaining to both
cases. Further, this paper will analyze the Constitutional heritage that may or may not have had
an impact on the decisions for both as well as if a Christian foundation has a role in the decisions
as well.
Outline
I. Obergefell v. Hodges, did Constitutional heritage and Christian heritage aid in
the decision of this case?
A. The Constitution protects one’s religious freedom.
B. The due process clause of the Fourteenth Amendment give equal
protection and due process.
II. Masterpiece Cake Shop v. Colorado Civil Rights Commission, did Constitutional
heritage and Christian heritage aid in the decision of this case?
A. The Constitution contends that we are all equal and should be treated as
so.
B. The First Amendment protects one’s right to exercise freedom of speech.
III Informed Analysis of Obergefell v. Hodges and Masterpiece Cake Shop v.
Colorado Civil Rights Commission,
A. The state has a right to decide whether to acknowledge one’s relationship
of someone of the same sex or not just as someone has the right to
refuse service based on religious beliefs.
B. There were Christian principles used in both rulings, as well as thorough
review of the Constitution.
