Background and Root Causes
Lancaster County School district does not have an official bathroom use policy.
Therefore in order to address this issue, an official policy should be created and presented to the
Lancaster County School District Board of Trustees. The issue of allowing students to use the
restroom based on their identity rather than their biological gender has become an issue
nationwide, as well as in the Lancaster County School District. Though there is no official law
that regulates how or which restroom a transgender or transitioning student may use, there have
been several court rulings on the issue. The problem with these rulings is that they differ
depending on which court has heard and made a ruling. There are several cases that say that not
allowing a transgender student to determine which restroom they use based on their gender
identity, does not discriminate based on Title IX of the Establishment Clause. While there are
other courts that have ruled that transgender students’ are being discriminated against. The policy
that I have created will require transgender and transitioning students to use the restroom of the
biological gender, or have access to a single stall restrooms as an alternative. As well as allowing
single stall access to all students. By allowing access to a single stall restroom for all students,
this provides students the opportunity to feel safe and protected.

Proposal of Policy
School Restroom Policy Regarding Gender-Specific Facilities
Purpose:
This policy aims to provide clear guidelines for restroom use within the school premises while
respecting the privacy, safety, and comfort of all students.

Policy Statement:
1. Gender-Specific Restrooms: Restroom facilities within the school premises are
designated as either male or female, based on biological gender distinctions.
2. Restroom Use: Students are expected to use the restroom facilities that correspond to
their biological sex assigned at birth, regardless of their gender identity or expression.
3. Alternative Options: Single stall restrooms are available as an alternative option for
students who prefer additional privacy or who may feel uncomfortable using gender-
specific restrooms. These single stall restrooms are accessible to all students and are
equipped with appropriate signage.
4. Respect and Sensitivity: School staff members are expected to treat all students with
respect and sensitivity regarding restroom use. Any concerns or requests regarding
restroom facilities shall be addressed in a confidential and respectful manner.
5. Non-Discrimination: Discrimination, harassment, or bullying of any student based on
their gender identity or expression is strictly prohibited. All students are entitled to a safe
and supportive school environment free from discrimination and harassment.
6. Parental Notification: Parents/guardians shall be notified of this restroom policy and any
related updates or changes. They are encouraged to discuss any concerns or questions
regarding restroom use with school administration.
Implementation:
This policy shall be communicated to all school staff members, students, and
parents/guardians through school newsletters, websites, and other appropriate channels.
Restroom facilities shall be maintained in a clean and hygienic condition, with
appropriate signage indicating their designated use.

Review and Revision:
This policy shall be periodically reviewed to ensure its effectiveness and compliance with
applicable laws and regulations. Any necessary revisions shall be made in consultation with
stakeholders, including students, parents/guardians, and community members.
Effective Date:
This policy shall take effect upon approval by the school administration and shall remain in
effect until amended or rescinded.
Expected Results
This policy will not only provide a place where students will be safe from harassment and
bullying, but also provide safety from sexual harassment. Overall, the proposed school restroom
policy promotes a culture of equity, inclusion, and cultural responsiveness among teachers and
staff by prioritizing the safety, privacy, and dignity of all students, regardless of their gender
identity or expression. Through clear guidelines, non-discrimination policies, and collaborative
communication with parents/guardians, the policy seeks to create a supportive environment
where every student feels valued and respected.
Advocating for Proposed Policy and Procedures
As the administrator proposing the policy and procedures, I would advocate for them
among teachers and staff by emphasizing the importance of creating a safe, and respectful
environment for all students not just a select few. I would inform them of the legal requirements
and ethical principles that are being addressed in the policy, outlining the school's commitment
to comply with anti-discrimination laws and promotion of equity and diversity. I would also
provide training sessions and informational materials to ensure that teachers and staff understand
the reasoning behind the policy and how to implement it effectively. I would allow teachers and

staff the opportunity to address any concerns or questions, seeking a collaborative approach to
policy implementation. Ultimately, I would emphasize that the policy reflects our shared values
of respect, dignity, and support for every student, and that its implementation is essential for
upholding these values in our school community.
