Question 1: Identify and describe the significant procedural steps in the American criminal
justice process that hold the most significance from the point of view of the prosecution?
The defense?
The American criminal justice process contains several procedural steps that carry
substantial implications for both the prosecution and the defense. From the prosecution’s
perspective, one of the most important stages is the decision to charge. Prosecutors exercise
comprehensive discretion in determining whether to bring charges, the nature of those charges,
and whether to pursue alternatives such as diversion or plea agreements. This discretion mostly
dictates the course of the case and impacts on the balance of power between the state and the
accused (Neubauer & Fradella, 2021). Another critical stage is pretrial discovery, during which
prosecutors must conform with constitutional obligations to disclose exculpatory evidence, as
conveyed in Brady v. Maryland (1963). Failure to do so not only threaten the integrity of the
proceedings but also weakens public trust in the justice system. Finally, the trial phase is
essential to the prosecution’s role, as the state carries the burden of proving the defendant’s
guilt beyond a reasonable doubt.
From a defense perspective, the process also contains critical junctures. The arraignment
and bail hearing is often the first opportunity for defense counsel to advocate on behalf of the
accused, seeking fair bail terms and protecting the client’s constitutional rights. The discovery
phase is particularly substantial for defense, as access to the prosecution’s evidence allows
counsel to prepare a suitable defense strategy and find weaknesses in the state’s case.
Additionally, the defense plays an vital role during plea negotiations, given that the majority of
cases are resolved through plea agreements rather than trials. The cross-examination of
witnesses during trial further illustrates the defense’s responsibility to defend the accused’s

Amendment rights and challenge the credibility of the state’s evidence.
Ultimately, both perspectives underline the necessity of procedural fairness to maintain
justice. As Proverbs 21:15 (KJV) states, “It is joy to the just to do judgment: but destruction shall
be to the workers of iniquity.” This principle emphasizes the moral foundation of due process,
ensuring that justice serves both the protection of society and the preservation of individual
rights.
Question 3: Identify the three (3) most important challenges facing the criminal justice
system in America in the next five (5) years. Describe why the challenges you have chosen
should be of greatest concern to those working/seeking to work in the field of criminal
justice.
The American criminal justice system is composed to confront several pressing
challenges over the next five years, each of which carries substantial inferences for practitioners
and policymakers. Among these, technological innovation and its consequences stand as a
primary concern. The rapid development of artificial intelligence, digital surveillance, and
forensic technologies has altered how evidence is gathered and presented in court. While these
tools offer opportunities for efficiency and accuracy, they also raise insightful questions
regarding privacy rights, evidentiary reliability, and constitutional safeguards. The courts must
adapt to these advancements in ways that preserve the integrity of the justice process
(Neubauer
& Fradella, 2021).
A second challenge is the juncture of mental health and criminal justice. Law
enforcement officers and courts are increasingly tasked with responding to individuals
experiencing behavioral health crises. Without ample diversion programs and community-based
treatment options, the system risks preserving a cycle of recidivism that fails both offenders and
society. Scholars stress that addressing this challenge requires not only resources but also a
paradigm shift that distinguishes treatment as a more effective alternative to traditional
punitive measures (Lurigio, 2019).
The third significant challenge involves public trust and system validity. Recent years
have seen heightened scrutiny of policing practices, prosecutorial discretion, and sentencing
disparities. These concerns have underscored the importance of transparency, accountability,
and equitable treatment. Restoring and maintaining public trust is crucial for ensuring
compliance with the law and for attracting and retaining qualified professionals in the field.
Collectively, these challenges demand attention because they strike at the core of justice
administration: fairness, effectiveness, and credibility. Scripture underlines this responsibility in
Micah 6:8 (KJV): “He hath shewed thee, O man, what is good; and what doth the Lord require of
thee, but to do justly, and to love mercy, and to walk humbly with thy God?” This verse stresses
the ethical obligation for criminal justice professionals to pursue justice with integrity,
compassion, and humility.
