Prepare a written report that presents a convincing disparate treatment claim that Gus
had been intentionally discriminated against on the basis of his age. Do not address the claim
as one of disparate impact.
We humans are psychologically motived by achievement, recognition, responsibility, and
promotional possibilities. If effective, an employer is in a dominate position to acquire, develop,
engage, retain skilled and motivated staff, necessary for the achieving of organizational
objectives as well as be responsible for the eliminating and reducing employee dissatisfaction.
After all, it is the employer that is the selecting entity, the one that screens applicants, and
performs intensive interview and screenings. It is the employer that also sets the boundaries for
