Choices in the Judicial System

The charges Brian is currently facing is child pornography in his possession, he was also

sharing and downloading thousands of images of child porn from state to state plus out of the

country. The reasoning behind charges is that recently there was an investigation conducted by

me and officer Yoder with internet crimes against children known as (ICAC) and during this

investigation Brian came upon our radar. A search warrant was obtained by us, and Brian’s

computer was seized and during his questioning he admitted to not only taking pictures but also

uploading them. Brian is looking at child pornography charges, possession of images of children,

transmission of child pornography not only across state lines but also out transmission out of the

country.

Child sexual exploitations investigations are mostly conducted by the FBI and what they

will do they will conduct a task force and will combine the resources of other agencies like state,

federal, local, and even with foreign law enforcement officers (FBI, 2020). Since the

investigation was started by the FBI, I believe that this case should be considered a federal case

and presented on the federal level. Brian could be prosecuted in every state that he committed

the crime but seeing that the crime crossed multiple states this will allow the Federal government

to take jurisdiction over the crimes (Schwartzbach, 2020).

The crimes that Brian are facing are serious crimes and any crimes that involves children

are not the kind of crimes where there will be any type of plea deal whatsoever. The cases

against Brian will be taken to the federal level seeing that his crimes violated not only state laws

but federal laws. The best court for this type of case will be on the federal level because I think

that we should make sure that he answers for this crime and there is no room for any type of plea

deal seeing that he is the one that admitted with taking the picture of the children that he worked

with and distributing them.

The reason that I think that we should not risk letting the cases that we have built up

against Brian go to state court is because we do not want to risk the state making any types of

plea deal with the defendant and my goal is for us to have all these charges prosecuted to the full

extent of the law and put this guy behind bars so that he will not be able to sexually assault or

abuse another child ever again. Imagine psychological issues that those families will be facing

for years to come by shutting down Brian and sending him to prison will stop a lot of people

from receiving the pictures or videos, if we could nab those predators one at time and be sure to

put the behind bars could someday make a big impact against the exploitation of children.
