Plea Bargain—Innovation or Imperfect?
Is “negotiated” justice—i.e., plea bargaining—a positive evolution in the criminal justice
system
When I think about negotiated just and plea bargaining do I feel that it is a positive
evolution in the criminal justice system? I would say yes and no looking at it from the
prosecution side of things I would say that the positives from a plea bargaining is that they would
no longer have to be burden with proving the guilt of a suspect trying to prove their case against
them. The other thing is that could happen because of excepting a plea bargaining and allowing
someone to have a lesser charge which could lead to them serving lesser time because of that the
prosecution or investigators could get information from them that could lead to bigger arrest or
even lead to information or help with unsolved crimes being solved by information provided by a
person that is willing to negotiate.
The person that is facing criminal charges on the other hand negotiation and plea
bargaining could be a positive thing for them. The suspect of a crime has the opportunity to
negotiate to accept a lesser charge for exchange of information or they may be given the chance
to except the negotiation as way of avoiding going to court and being possibly found guilty of a
bigger crime and then facing a lengthy sentence it can also mean for the suspect the difference of
being charged with a misdemeanor instead being charged with a felony which will allow the
suspect to avoid the negative effects of having a felony charge on their records. The one
negative that I think this does is that there are families that sometimes do not get the justice that
they deserve by agreeing with a plea agreement along with the prosecution.
