Assignment: Today's Supreme Court has evinced a decided leaning to the right and away from protection of the rights of criminal defendants. During a recent term, the court decided a case about the Florida electric chair. It seems the chair has malfunctioned the last three times it was used and in a horrific display actually set the inmate on fire before killing him. Florida's Attorney General was quoted as saying that it has deterrent effect and criminals better think twice about committing a capital offense in Florida because "our electric chair doesn't work very well." A death row inmate petitioned the Supreme Court to declare that the likelihood of horrific execution constitutes cruel and inhuman punishment in violation of the Eight Amendment.
