Again, what is the most litigated issue in all of special education? Yes, Least Restrictive Environment. Why is it so litigated? You should have some of the answers to that question after completing the reading assignment for this module. However, it is critical to see that special education in general is VERY litigated and there are many central issues in addition to the ones surrounding LRE.

Your assignment is to summarize and provide a brief critique of a court case that involves an issue in special education. You are to attach a Word document with this summary and critique.

2. choose a case that looks interesting to you

3. in a Word document, prepare a written summary and brief critique including at least:

● title of case ● participants (plaintiffs, defendants) ● case number ● central special ed. issue/mandate involved. What was the reason/impetus for

the case or the reason it was brought to trial? (LRE, IEP, discipline, related services, burden of proof, placement, etc...)

● a summary of the case: who initiated it? why? in regards to what? what was the perceived or alleged violation? who was allegedly at fault? what was the outcome? was it settled? how was it settled?

● a brief critique of the case in your own words and opinion.

The cases are long and comprehensive so be prepared to skim for important information. You do not have to be intimately familiar with the case in order to answer these questions. Again, you do not have to choose a LRE case but you may if you wish. Most of them are LRE arguments or at least began that way.

The completed written product should end up being around 1.5-2 pages in length. Please do not forget to include your opinion/critique.
