Unit 3 Discussion Topic 1: Torts and Cyber Torts

Throughout this course, many discussion opportunities come up where you need to respond to other people's opinions and comments. Then, respond to your Discussion topic after you have completed your Reading.

The Cardigans through CARDWARE have introduced a new “Let’s Keep Warm” matching clothing line for toddlers and children up to age six and their dolls. The clothing line is unique as the sweaters have charms on them that are suitable for a variety of occasions. For example, there are Valentine’s Day sweaters with various hearts attached to the pockets. Included in this newest production are matching clothes for dolls that have the exact small charms and buttons that the toddler/children line has on them. Kendra, a 4-year old was given a sweater for her and her doll for her birthday. One of the charms, a birthday cake, fell off of one of the pockets of Kendra’s doll’s sweater, as the stitching did not secure the charm in place. Kendra picked it up and put it in her mouth to show her doll that the cake was delicious. Unfortunately, she began to swallow the charm. Luckily, her mother was walking by Kendra’s room where she was playing and saw the toddler choking. She was able to retrieve the small item from her airway. Kendra, however, is now devastated and not only has a cut in her esophagus from the charm, but is distraught and is having nightmares over her or her doll wearing their matching sweaters.

Next, determine the following:

1. Would you report the incident to the Consumer Product Safety Commission? Explain.

2. Discuss whether you would sue the manufacturer/CARDWARE based on negligence or strict liability.

3. Identify potential manufacturer defenses. Explain.

Something to Think About: Should there have been a warning placed on the sweater or packaging?

1. Discuss whether or not strict liability and/or negligence would apply to the scenario.

2. Examine the doctrine you would utilize in a lawsuit against CARDWARE.

3. Discuss the various defenses available under the chosen tort.

Sharing Your Own Experience in an Informal Document

Have you ever sat down to write a document and thought, where do I even begin? Sitting and staring at a blank page while trying to develop ideas can be frustrating. Trying to write an essay, a memo, a professional email, or any other document in one sitting can be difficult and often leads to writer’s block. Prewriting is an easy step to avoid frustration and writer’s block. Prewriting is an excellent way to consider what you already know about a topic, begin generating ideas, and plan to write.

Prepare: Complete the assigned Unit 3 Reading and Learning Activities.

Preview the  Unit 4 Assignment details  and generate possible topic ideas for your Unit 4 Assignment.

Post: Post a discussion that identifies at least one to two possible topics for your blog post. Explain to the class why you chose these possible topic ideas and what experience you have with them. Identify possible audiences and how the information you share will help your audience. Tell the class which topic you think you might select and why. 

Post a prewriting activity for one of your identified topics. You might post a short paragraph of freewriting, for example.

Include an open-ended question about any issue your initial post raises which your classmates can help you with.

Respond: Respond to classmates’ postings

Participate by responding to at least two classmates’ initial postings. Ask questions about the audience and purpose. Take on the role of your classmates' new audience and discuss what you as an audience member would need to be informed about, what your expectations would be, and what you would hope the article would do to inform you about these important issues. This type of roleplay can be helpful in understanding the needs of the reader and how to best reach your intended audience.

Journal

In Units 3, 5, 7, and 9, you will practice your informal writing skills by writing in a Journal. Your Journal assignments will not only give you more experience with writing, but they will also offer you an opportunity to write without the stress often associated with formal projects. Journals become a way to connect course concepts to personal experiences, a place to process how things are going for you in the course, and a way to de-stress.

· As long as your response is on topic and submitted on time, you will receive 10 points for each Journal submission.

· Your Journal entries will only be read by your instructor, so think of them as being informal pieces of writing that are intended for you to express yourself and share ideas with your instructor who will provide you feedback on your Journal to encourage your growth as a writer.

CREDIT (10 Points): Journal is submitted on time and responds to the specific topic in a well-developed paragraph.

NO CREDIT (0 Points): Journal assignment is not submitted or it may not respond to the specific topic or may be so brief that it does not develop or clarify ideas.

Unit 3 Journal Prompt

One of the ways that informal writing if often used is in communicating thoughts, concerns, ideas, and goals to others. In this Journal, imagine that a friend, family member, or personal acquaintance is thinking about returning to school to further his or her education or training.

Write either an email or letter to this friend, encouraging him or her to return to school. Use your own personal experience to motivate and show the friend how he or she can face the challenges that college might bring. Also offer suggestions related to time management and setting goals.
