1. Answer the following:

I. Define the concept of Products liability and how a business may be liable for the products it sells. Product liability is, “the legal liability a manufacturer or trader incurs for producing or selling a faulty product,” according Dictionary.com. In short, a manufacturer or seller is responsible for any flaws in the function, appearance, or integrity of the product sold to customers. Defective products can become dangerous products, thus, putting the manufacturer a predicament of having to defend the integrity of the company. Typically, businesses are held liable for injuries caused by defective products because it is seemed as though the company would be selling products that are in the best interest for the consumer. Customers are dependent on a company to do its due diligence in creating safe, efficient products that they may have advertised in a specific way. This can also result in misleading advertisement. Injuries for defective products can be greatly life changing and if the company isn’t held responsible, there is no repercussion to other companies creating faulty products. II. The next section must be answered. It is 20% of the assignment grade. Part two, to respond you will need to review all the student posts. In business you will need to evaluate “employee” performance. This exercise is to develop the skill of evaluating others performance. Note: Your performance is evaluated in question 4. I will also evaluate your participation and performance, and our evaluations should agree. Be candid, you get points for identifying areas that need improvement, none for ignoring them.

2. Which student(s) had the best response to the discussion questions?  Explain and give examples.

One of the students that stood out this week is Martin de. He has been very thorough in his posts and responses. I also appreciate that Martin will not only answer thoroughly to other peoples’ post, but also reply to those who’ve replied on his post. I think it’s important to continue the dialogue and make it a two-way conversation instead of one-ended. Any feedback on our personal posts is important so connecting back with the students is crucial. He has done that well. He chose a great example of intentional tort and used terminology related to the powerpoint. His replies are genuine and offer a continual process for thoughts to flow. Additionally, David O also stood out for being constantly engaged in his posts as well as those who have replied. His article about Wynn vs Francis easily illustrated his knowledge of slander, and I think helped students understand the terminology related to slander. He puts much thought into his answers for other posts and puts effort into engaging with students. Comment by Rick Manzano: Evaluates more than one student who had good posts.

3. Which student(s) would you rate the lowest for the discussion?  Why?

The students to rate the lowest in my opinion are Christopher G… and Gene R…. because I think that there was a lack of effort to participate the whole week in the discussion. I like to analyze the different responses and the timing of their posts and replies and it seems like all the participation is left for the last few days. Also, I didn’t see much participation with other students’ posts. Their posts were not bad but it seems rushed. 4. How can you improve your performance? (Note: nothing gets nothing.)

This week I think I lacked on my daily posts. I’ve been sick, so I haven’t been functioning as regular. As an adult I recognize that getting sick is no excuse for underperforming, but it’s been a tough week. However, I did enjoy this week’s reading, and I think it’s reflected in the student’s discussion as well. I saw more engagement this week than weeks before and I see that students are enjoying the material. It’s difficult to connect with students via online class but this discussion creates a more real in class conversation. I know I can become more involved in that conversation and that is my goal for the following weeks. Comment by Rick Manzano: in-depth self evaluation
