Dear Sir,

Please review the below recommendations that include potential risks that might affect the project progress, budget and schedule:

· The soil report showed rock at 5 feet below existing grade and we’d excluded hard dig from the bid. This information is not adequate for soil settlement standards and any future acquired responsibility must be excluded through a written contract if a further study of deeper soil conditions is not performed.

· The construction drawings are provided by an architect, Orcutt Winslow, who I have never worked with before and that is of concern to me. Since that is the case, I’m not aware of the architects drawing approach and I can’t anticipate the details of his work and the results in errors, rework, wasted time, field workarounds, and adjustments that might come of it. This also goes for the architect not know me. This concern also goes for working with a new management team, CBRE.

· Since the project was awarded on a low bid basis, I would recommend an advanced schedule to avoid possible setbacks and delays.

· Since the lender is insisting on at least 30 days to review each payment request and that no contractor serve 20-day notices for the project until after the construction loan is fully funded, we recommend that we create invoices in advance to allow adequate cash flow throughout the project and avoid any delays in schedule and work.

· Per the construction loan, if it is not converted to permanent financing within 12 months, the owner will be required to extend the loan, which may cost additional money and for that we’d like a written letter that protects us from any future responsibility or inclusion of any further charges after the project is done.

· Another issue that must be raised is the exclusion of the parking lot and that might impede the low bid contract agreed upon and we ask that you draft a formal letter to avoid any responsibility in the future.
